requiring certain projects for the development or improvement of broadband, telecommunication or fiber optic services to comply with provisions governing public works;
requiring a contractor or subcontractor engaged on certain public works that are projects for the development, deployment or improvement of broadband, telecommunication or fiber optic services to submit certain records to the Board of Directors of the Nevada State Infrastructure Bank;
requiring a contractor or subcontractor engaged on such a project to submit certain records to the Board of Directors of the Nevada State Infrastructure Bank;
specifying that the provisions governing public works do not apply to certain contracts;

Existing law requires a contractor or subcontractor to ensure that a copy of each such record for each calendar month is received by the public body 338.070) Section 1 of this bill requires a contractor or subcontractor engaged on a public work that is a project for the development, deployment or improvement of broadband, telecommunication or fiber optic services who submits to the public body awarding the contract a copy of such a record to simultaneously submit a copy of the record to the Board of Directors of the Nevada State Infrastructure Bank.
Existing law requires a contractor or subcontractor to ensure that a copy of each such record for each calendar month is received by the public body awarding the contract not later than 15 days after the end of each month.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
(NRS 338.070) This bill requires a contractor or subcontractor engaged on a project - *AB303* – 2 – described above who submits to a public body a copy of such a record to State Infrastructure Bank.py of the record to the Board of Directors of the Nevada THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
A contractor or subcontractor engaged on a public work that is a project for the development, deployment or improvement of broadband, telecommunication or fiber optic services who, pursuant to subsection 6 of NRS 338.070, submits to the public body awarding the contract a copy of a record required pursuant to subsection 5 of NRS 338.070 shall simultaneously submit a copy of the record to the Board of Directors of the Nevada State Infrastructure Bank.
Sec.
2.
NRS 338.011 is hereby amended to read as follows:
338.011 The requirements of this chapter do not apply to a contract:
In addition to any other requirements imposed by federal or state law, the provisions of this chapter apply to any project for the development or improvement of broadband, telecommunication or fiber optic services for which public money has been provided and that is sponsored, financed, overseen or administered by a public body, including, without limitation, through the disbursement of money by the public body or the issuance by the public body of a request for procurement, in the same manner as if the public body awarded a contract for the project, even if the project does not qualify as a public work.
Awarded in compliance with chapter 332 or 333 of NRS which is directly related to the normal operation of the public body or the normal maintenance of its property.
A contractor or subcontractor engaged on a project described in subsection 1 that submits to a public body a copy of a record required pursuant to subsection 5 of NRS 338.070 shall simultaneously submit a copy of the record to the Board of Directors of the Nevada State Infrastructure Bank.
Awarded to meet an emergency which results from a natural or artificially created disaster and which threatens the health, safety or welfare of the public.
If the public body or its authorized representative determines that an emergency exists, a contract or contracts necessary to contend with the emergency may be let without complying with the requirements of this chapter.
If such emergency action was taken by the authorized representative, the authorized representative shall report the contract or contracts to the public body at the next regularly scheduled meeting of the public body.
As used in this section, “public body” has the meaning ascribed to it in NRS 338.010 and includes, without limitation, the Office of Science, Innovation and Technology in the Office of the Governor.
