(1) The county board of commissioners of a county, by resolution adopted by a 2/3 vote of all its members, may create a county parks and recreation commission, which shall must be under AIS H04910'25_HB5317_INTR_1H04910'25_HB5317_APH_1 0hx842hxy3ef 1 the general control of the county board of commissioners.
Beginning January 1, 2027, if a AIS H04910'25_HB5317_INTR_1H04910'25_HB5317_APH_1 0hx842hxy3ef 1 county has a population of less than 100,000, the county board of commissioners of that county may reduce the number of members appointed under this subdivision to 4 members, not less than 1 and not more than 3 of whom must be members of the county board of commissioners.
(3) Of the members first appointed by the county board of commissioners, 2 shall must be appointed for a term ending 1 year from the following January 1, 2 for a term ending 2 years from the following January 1, and 3 for a term ending 3 years from the AIS H04910'25_HB5317_INTR_1H04910'25_HB5317_APH_1 0hx842hxy3ef 1 following January 1.
