Plain-language change summary

The updated version of HB 236 now requires certain taxing entities that want to raise property tax rates to hold a public meeting and provide a preliminary statement explaining the proposed increase. It also clarifies that the State Tax Commission can deny a tax rate increase if the entity doesn't meet specific transparency requirements. Importantly, there's a new one-year grace period allowing taxing entities more time to comply without immediate penalties for non-compliance. These changes are crucial as they enhance transparency and hold taxing entities accountable to the public regarding their tax increase proposals.

Compared against the Utah Code as published AI-generated reading aid — verify against the official bill.

The bill modifies notice and procedural requirements for tax rate increases by fiscal year taxing entities in Utah.

  • 59-2-919

    provides notice by meeting the advertisement requirements of Subsections (6) and (7) before the fiscal year taxing entity conducts the public meeting at which the fiscal year taxing entity's annual budget is adopted; and → an executive officer or budget officer of the taxing entity states that the tentative budget includes a proposed tax rate increase and presents a property tax impact schedule.

    This change requires fiscal year taxing entities to present a preliminary statement about proposed tax rate increases in public meetings.

  • 59-2-919

    provides for a one-year period in which the State Tax Commission is not required to deny a fiscal year taxing entity's proposed tax rate increase for failure to comply with certain truth in taxation requirements;

    This modification provides temporary leniency for fiscal year taxing entities regarding compliance with truth in taxation requirements.

  • 59-2-919

    reserve a certain amount of the taxing entity's general fund revenue in a restricted budget account for a limited period of time;

    The requirement to reserve general fund revenue in a restricted account allows for better financial planning regarding proposed tax increases.

  • 59-2-919

    clarifies the State Tax Commission's authority to deny a taxing entity's proposed tax rate increase for failing to meet truth in taxation requirements;

    This clarification strengthens the State Tax Commission's enforcement power concerning tax rate increases.

  • 59-2-919

    clarifies notice and publication requirements for towns proposing a tax rate increase that do not have public websites;

    This ensures that towns without websites still adhere to proper notice requirements for tax increases.
