The amendment to Bill HB 268 authorizes the Department of Transportation to create rules for a specific process, although the bill does not allocate any funds for this purpose or include any additional special clauses. Additionally, the bill clarifies the need to notify all parties with an interest in a vehicle, vessel, or outboard motor before removal. This change is important because it ensures that affected individuals are informed and can take action before their property is removed, promoting fairness and transparency in the process.

The bill enhances protections for owners or lien holders of towed vehicles by making possessory liens unenforceable and allowing vehicle retrieval without fees if proper notice is not provided.
-
72-9-603
a possessory lien described in Subsection (13) is unenforceable against a party described in Subsection 41-6a-1406(6)(a).→ a possessory lien related to a vehicle that has been towed is not enforceable if required notice was not properly provided to the owner or lien holder. This change establishes that liens can't be enforced if towing notice requirements are not met.
-
72-9-603
an owner or a lien holder may take possession of a vehicle without paying towing or storage fees if notice was not properly given.
This addition allows owners or lien holders to recover their vehicle for free if notice procedures are violated.
-
72-9-603
If an owner claims notice was not properly provided, a presumption of improper notice is created that can be rebutted by presenting certain evidence.
This creates a rebuttable presumption to help protect vehicle owners in disputes regarding notice.
-
72-9-603
The prevailing party in an action related to lack of notice may be awarded attorney fees.
This allows for recovery of legal costs for parties who win disputes over notice violations.
-
72-9-603
The Department of Transportation is authorized to create rules for the process for an owner or lien holder to make a claim for release of a vehicle.
This gives the Department of Transportation the authority to establish clear procedural rules for claim processes related to towing.
