(f)AAIn setting performance levels for a criterion-referenced assessment instrument adopted or developed under Subsection (e), the commissioner shall implement procedures to maintain the validity and reliability of the assessment instrument, including procedures for field testing items approved by the teacher committees described by Subsection (c).
(3)AAthe number of questions that must be answered H.B.ANo.A8 correctly to achieve satisfactory performance under the college readiness performance standard as provided by Section 39.0241;
(h)(h)AAAn AAAn assessment instrument adopted or developed under Section 39.023 must be designed to support accommodations for students in a special education program under Subchapter A, Chapter H.B.ANo.A8 29.
If a student is in a special education program under Subchapter A, Chapter 29, the studentstudent’s s admission, review, and dismissal committee shall determine whether any allowable accommodation is necessary in administering to the student an assessment instrument required under Section 39.023.
H.B.ANo.A8 (j)AAAn assessment instrument administered under Section 39.023 may be administered in multiple parts over more than one day.
(k)(k)AAAn AAAn assessment instrument adopted or developed under Section 39.023 must be designed to minimize the impact on student H.B.ANo.A8 instructional time so that:
(l) AASubject to Subsection (d-1), the agency shall notify school districts and campuses of the results of assessment H.B.ANo.A8 instruments administered under Section 39.023 not later than two business days after the date the applicable administration schedule window under Subsection (i) closes.
The results should include a diagnostic report for each student and recommendations for use by teachers and parents for practical and useful instructional strategies to better meet the individual needs of the student based H.B.ANo.A8 on the student’s performance on the assessment instrument.
SECTION A1.006.AASection 39.025(a-2), Education Code, as H.B.ANo.A8 amended by S.B.
(a-2) AAThe commissioner shall determine a method by which a studentstudent’s s satisfactory performance on an advanced placement test, an international baccalaureate examination, the SAT, the ACT, an assessment instrument designated by the Texas Higher Education H.B.ANo.A8 Coordinating Board under Section 51.334, or any nationally recognized norm-referenced assessment instrument used by institutions of higher education to award course credit based on satisfactory performance on the assessment instrument shall be used to satisfy the requirements concerning an end-of-course assessment instrument in an equivalent course as prescribed by Subsection (a).
ATo the extent authorized by federal law, a student may take a test or other assessment instrument authorized under this subsection in lieu of the appropriate end-of-course assessment instrument.
The commissioner shall adopt rules as necessary for the administration H.B.ANo.A8 of this subsection.

(c-5) AAThe agency shall develop a measure of student through-year instructional growth and improvement from the beginning of the school year through the end of the school year for evaluating the performance of campuses serving grade levels in which beginning-of-year and middle-of-year assessment instruments adopted or developed under Section 39.023 are required to be H.B.ANo.A8 administered.
(c-6)AANotwithstanding(c-6) AANotwithstanding Subsections (f-1) and (f-3), not later than the 2029-2030 school year, the commissioner shall incorporatepresent intothe measure described by Subsection (c-5) to the indicatorsaccountability adoptedadvisory committee established under thisSection subchapter39.0534 to consider the incorporation of the measure developedinto underthe indicators described by Subsection (c-5)(c)(2)(A) notand laterin thanany other domain or indicator the 2029-2030commissioner schoolconsiders year.relevant.
ThisNot subsectionlater expiresthan SeptemberMarch 1,15, 2031.2029, the agency shall submit to the governor, the lieutenant governor, the speaker of the house of representatives, and the chairs of the standing legislative committees with primary jurisdiction over public school accountability a report regarding the measure described by Subsection (c-5).
(c-7)AAForThis purposes of Subsection (c)(3), the agency shall H.B.ANo.A8 use appropriate alternative prior-year data to evaluate the performance under that subsection ofexpires aSeptember newly1, established2030. campus that lacks the prior-year data necessary to complete a portion of the calculation methodology that relies on prior-year campus data.

(f)AAAnnually,(c-8) theAAFor commissionerpurposes shallof defineevaluating school districts and maycampuses modifybased on a college, career, and military readiness indicator adopted under Subsection (c) that requires the stateuse standardsof [standardprior-year forinformation, the currentagency shall ensure that a school year]district formay eachsubmit [achievement]additional prior-year information relating to the indicator adoptedduring underthe thisspecified subchaptertime inperiod [section.AAIn]during consultationwhich withthe educators,district parents,may andsubmit businessadditional andcurrent-year industryinformation representatives,for asthat necessary.indicator.
H.B.ANo.A8 (f)AAAnnually, the commissioner shall define and may modify the state standards [standard for the current school year] for each [achievement] indicator adopted under this subchapter in [section.AAIn] consultation with educators, parents, and business and industry representatives, as necessary.
and (2)AAensuring [to ensure] this state ranks nationally [is a national leader] in the top five states in preparing students H.B.ANo.A8 for postsecondary success and on the National Assessment of Educational Progress or its successor assessment.
(f-1)(f-1)AABeginning AABeginning with the indicators adopted for the 2027-2028 school year and as required to meet the goals under Subsection (f), the commissioner shall increase the scores needed to achieve performance standards on indicators adopted under this subchapter only every fifth school year unless an indicator adopted under Subsection (c) requires adjustment before that school year to ensure consistency of performance standards.
(f-2)AANot later than the 30th day before the date the commissioner adopts a rule modifying the performance standards under Subsection (f-1), the commissioner shall submit to the H.B.ANo.A8 governor, the lieutenant governor, the speaker of the house of representatives, and the chairs of the standing legislative committees with primary jurisdiction over public school accountability a report that:
(f-3)(f-3)AAFor AAFor each of the two school years preceding a school H.B.ANo.A8 year the commissioner increases a score under Subsection (f-1), the commissioner shall report, in a manner that can be reviewed by school administrators, the overall performance of school districts and campuses under that increased score.
(f-4)AAIn(f-4) AAIn reporting the performance of school districts and campuses on indicators adopted under this subchapter for a school year in which the score needed to achieve performance standards on H.B.ANo.A8 one or more of those indicators was increased under Subsection (f-1), the commissioner shall include in the report an informational report on the performance of districts and campuses during the preceding school year under the increased score.
and H.B.ANo.A8 (2)AAthe certifications included in the credential library established under Section 2308A.007, Government Code.
(b)(a-1)AAFor AAThepurposes of Subsection (a), the agency’ s provision of a proposed list or a modified proposed list of industry certifications includedto inthe Texas Higher Education Coordinating Board and the listTexas developedWorkforce Commission satisfies the requirement under Subsectionthat (a)subsection must:to jointly develop a list of industry certifications, unless the board or commission submits to the agency revisions to the proposed list or modified proposed list on or before the 90th day after the date the agency provides the proposed list or modified proposed list to the board or commission.
(b) AAThe industry certifications included in the list H.B.ANo.A8 developed under Subsection (a) must:
(d) AAIf, after reviewing an industry certification under H.B.ANo.A8 Subsection (c), the entities described by Subsection (a) determine the certification is no longer eligible for purposes of Section 39.053(c)(1)(B)(v) and should be removed from the list developed H.B.ANo.A8 under Subsection (a), the entities shall, to the extent practicable, post on their respective Internet websites information regarding the removal of the certification not later than two years before the date the entities intend to remove the certification from the list.
(b)(b)AAA AAA school district or open-enrollment charter school may, but is not required to, provide to the agency information H.B.ANo.A8 regarding the following indicators at a district or school campus that serves students in prekindergarten through eighth grade:
(1)AAan indicator that accounts for the percentage of H.B.ANo.A8 students participating in school-sponsored extracurricular or cocurricular student activities consistent with the findings of the extracurricular and cocurricular student activity indicator study required under Section 39.0533, as that section existed immediately before September 1, 2023;
(c)(c)AAThe AAThe agency shall post the information collected under Subsection (a) on the Texas School Accountability Dashboard developed under Section 39.309.
(d) AAThis section may not be construed to limit the authority H.B.ANo.A8 to modify performance indicators under Section 39.053 to include indicators described by this section.
(a) The H.B.ANo.A8 commissioner shall establish an accountability advisory committee to advise the commissioner and the agency regarding the adoption and modification of performance standards and indicators required under this chapter.
(c)(c)AAThe AAThe committee shall provide minutes of each committee meeting within a reasonable time after the meeting to the governor, the lieutenant governor, the speaker of the house of representatives, and each member of the standing legislative committees with primary jurisdiction over primary and secondary education.
H.B.ANo.A8Sec. Sec.A39.0535.AAPERFORMANCE INDICATORS STUDY.
(a)A39.0535.AAPERFORMANCE TheINDICATORS commissionerSTUDY. shall enter into a memorandum of understanding with an institution of higher education to conduct a study regarding methods to diversify the performance standards required for domains and indicators of achievement adopted under this subchapter, such as the potential impact of developing indicators that account for educator quality, advanced academic coursework, student engagement, workforce development, parental engagement, and school climate.
(a) The commissioner shall enter into a memorandum of understanding with an institution of higher education to conduct a study regarding H.B.ANo.A8 methods to diversify the performance standards required for domains and indicators of achievement adopted under this subchapter, such as the potential impact of developing indicators that account for advanced academic coursework, student engagement, workforce development, and parental engagement.
An overall or domain performance H.B.ANo.A8 rating of B reflects recognized performance.
An overall or domain performance rating of F H.B.ANo.A8 reflects unacceptable performance.
H.B.ANo.A8 (1)AAthe district or campus is located in an area that is subject to a declaration of a state of disaster under Chapter 418, Government Code, and due to the disaster, performance indicators for the district or campus are difficult to measure or H.B.ANo.A8 evaluate and would not accurately reflect quality of learning and achievement for the district or campus;
Any interventions or sanctions to which a school district or campus is subject under Chapter 39A shall continue during a period in which the district or campus is assigned an overall performance rating of "Not Rated." (a-6) AAThe commissioner may not assign an overall performance rating of "Not Rated" to all school districts or all H.B.ANo.A8 campuses on a statewide basis.
(a-7) AAIf the agency makes changes to the assessment program under Section 39.022 for assessment instruments administered under this subchapter that require new standards for issuing performance H.B.ANo.A8 ratings under this section, the agency must conduct a performance comparison analysis between the program as changed and the preceding program to establish roughly comparable standards for issuing performance ratings.
(c)(c)AAThe AAThe commissioner shall make the information under Subsection (a-3) available as soon as reasonably possible in years in which the standards are modified or recalibrated or in which a new assessment instrument is offered.
(a)AANot(a) AANot later than July 15 of each [Each school] year, the H.B.ANo.A8 commissioner shall provide each school district a document in a simple, accessible format that explains the accountability performance standards adopted under Sections 39.0241 and 39.053(f) for the following school year and the measures, methods, and H.B.ANo.A8 procedures that will be applied for that school year in assigning each school district and campus a performance rating under Section 39.054.
H.B.ANo.A8(c) (c)AAIfAAIf the commissioner does not approve a campus turnaround plan, the commissioner shall order:
H.B.ANo.A8 (2)AAalternative management of the campus;
H.B.ANo.A8 SECTIONA2.013.AASubchapter Z, Chapter 39A, Education Code, is amended by adding Section 39A.908 to read as follows:
Sec.Sec.A39A.908.AAINTERVENTIONS AND SANCTIONS WHILE ASSIGNMENT OF PERFORMANCE RATINGS ENJOINED.
A39A.908.AAINTERVENTIONS(a) ANDNotwithstanding SANCTIONSany WHILEother ASSIGNMENTH.B.ANo.A8 OFlaw, PERFORMANCEduring RATINGSa ENJOINED.period in which the agency is enjoined from assigning performance ratings to a school district, open-enrollment charter school, or district or school campus, any previously imposed interventions or sanctions to which the district, school, or campus is subject shall continue throughout that period.
(a) Notwithstanding any other law, during a period in which the agency is enjoined from assigning performance ratings to a school district, open-enrollment charter school, or district or school campus, any previously imposed interventions or sanctions to which the district, school, or campus is subject shall continue throughout that period.
H.B.ANo.A8(d) (d)AAToAATo ensure the expeditious implementation of interventions or sanctions under this chapter, the agency may modify or waive a deadline or time frame required by law or agency rule applicable to the assignment of performance ratings for a H.B.ANo.A8 school year for which the agency was enjoined from assigning performance ratings.
(e)AAExcept(e) AAExcept as provided by Subsection (f), the agency shall impose an intervention or sanction described by Subsection (b)(2) or (c)(2) as required by law unless the intervention or sanction, as determined by the commissioner:
(g)AAExcept(g) AAExcept as provided by Subsection (h), the commissioner shall revoke a charter holder ’s charter for an open-enrollment charter school for which the charter holder received a charter H.B.ANo.A8 renewal based on the absence of a performance rating for a school year for which the agency was enjoined from assigning a performance rating if, after the assignment of performance ratings for that year, the charter would not have been renewed under Section H.B.ANo.A8 12.1141(d), regardless of the performance of the school in a subsequent school year.
(h)AASubsection(h) AASubsection (g) does not apply to a charter holder for which the agency has renewed the charter based on the charter holder entering into and meeting the requirements of a performance agreement with the agency.
SECTIONA2.014.AASectionSECTION A2.014.AASection 2308A.007, Government Code, is amended to read as follows:
(A)AAthe information included in the electronic H.B.ANo.A8 tools or platforms developed by the coordinating board under Section 61.09022(a), Education Code;
and H.B.ANo.A8 (2)AAensure data interoperability between relevant state agencies.
(b)AAThe(b) AAThe coordinating board and the commission jointly shall [may] designate a host agency to contract with an experienced and recognized third-party vendor [or operating entity] for the [a] credential library established under this section.
(c)AAIn(c) AAIn establishing the [a] credential library under this section, the coordinating board and the commission shall solicit input from the agency and relevant stakeholders.
SECTIONA2.015.AASectionsSECTION A2.015.AASections 312.003(a) and (c), Labor Code, as amended by H.B.
(a)(a)AAThe AAThe advisory council shall develop an inventory of industry-recognized certifications that may be earned by a public high school student through a career and technology education program and that:
(c)AAIn(c) AAIn developing the inventory, the advisory council shall H.B.ANo.A8 [may] consult with local workforce boards, the Texas Workforce Investment Council, the Texas Economic Development and Tourism Office, the Texas Education Agency, and the Texas Higher Education Coordinating Board.
H.B.ANo.A8 SECTIONA2.016.AAThe following provisions of the Education Code are repealed:
(c)(c)AAA AAA school district or open-enrollment charter school must bring an action for declaratory judgment under Section 2001.038, Government Code, challenging the validity or H.B.ANo.A8 applicability of a rule adopted under this chapter or Chapter 39A not later than nine months after the date the rule is adopted.
H.B.ANo.A8 Sec.A39.009.AACOMPLIANCE WITH CERTAIN CHAPTER REQUIREMENTS;
H.B.ANo.A8(e) (e)AAAAAA school district or open-enrollment charter school may not challenge on any basis, including a lack of commissioner or agency authority, an agency decision relating to an academic or financial accountability rating under this chapter, including a H.B.ANo.A8 decision relating to a determination of consecutive school years of unacceptable performance ratings, in another proceeding unless [if] the district or school has exhausted the district’s or school’s remedies [had an opportunity to challenge the decision] under this section.
H.B.ANo.A8(e) (e)AAExceptAAExcept as provided by Subsection (f), a school campus or district may not receive an exemption or waiver under this section from:
(1)AAa prohibition on conduct that constitutes a H.B.ANo.A8 criminal offense;
H.B.ANo.A8 (J)AAeducator rights and benefits under Subchapters A, C, D, E, F, G, and I, Chapter 21, or under Subchapter A, Chapter 22;
(K)AAspecial education programs under Subchapter H.B.ANo.A8 A, Chapter 29;
(3)AAprovide for targeted professional development for classroom teachers in kindergarten or first, second, or third grade who are assigned to campuses that the board of trustees identifies as not meeting the plan’splan s goals;
H.B.ANo.A8 (A)AAcoordinate implementation of the plan;
and H.B.ANo.A8 (5)AAbe reviewed annually by the board of trustees at a public meeting.

(6)AAfor a reading instrument for students in kindergarten and first grade, include the applicable elements and H.B.ANo.A8 criteria to serve as the required screenings for dyslexia and related disorders under Section 38.003;
If the district would otherwise be required to provide supplemental instruction to a student in more than two subject areas for a school year, the district shall prioritize providing supplemental instruction to H.B.ANo.A8 the student in mathematics and reading language arts, or Algebra I,I or[,] English I, or[or English II,II,] as applicable, for that school year.
(o)(o)AAThis AAThis section does not require the administration of a H.B.ANo.A8 fifth or eighth grade assessment instrument in a subject under Section 39.023(a) to a student enrolled in the fifth or eighth grade, as applicable, if the student:

(g) AAA district may transfer an emergent bilingual student H.B.ANo.A8 out of a bilingual education or special language program for the first time or a subsequent time if the student is able to participate equally in a regular all-English instructional program as determined by:
(a) AAThe agency shall produce and make available to the public on the agency s Internet website annual district and campus-level reports containing information from the previous H.B.ANo.A8 school year on early education in school districts and open-enrollment charter schools.
H.B.ANo.A8 (1)AAthe information required by Section 29.1532(c) to be reported through the Public Education Information Management System (PEIMS);
(A)AAwhether the student met the kindergarten H.B.ANo.A8 readiness standard on a reading instrument adopted under Section 28.006;
(B)AAwhether the student attended prekindergarten H.B.ANo.A8 in the district, including a program offered through a partnership under Section 29.153;
H.B.ANo.A8SECTION SECTIONA4.009.AASectionsA4.009.AASections 39.02342(a) and (b), Education Code, are amended to read as follows:
(a) AASubject to Subsection (c) and notwithstanding Section H.B.ANo.A8 39.023, a school district may administer in paper format a nonadaptive assessment instrument adopted or developed by the agency as a substitute for an assessment instrument required under Section 39.023(a), (c), or (l) [in paper format] to any student whose parent, guardian, or teacher in the applicable subject area requests the assessment instrument be administered to the student in paper format.
(b)(b)AAA AAA request for the administration of an assessment instrument in paper format to a student under this section must be submitted to the school district not later than a reasonable date as determined by the agency, which must be not later than the 60th day before the date the applicable assessment administration schedule window under Section 39.02301(i) closes[:
(e)(e)AAThe AAThe agency shall implement the pilot program established under this section beginning with the 2028-2029 school year.
H.B.ANo.A8SECTION SECTIONA4.011.AASectionA4.011.AASection 39.0238(b), Education Code, is amended to read as follows:
(b)(b)AAThe AAThe board of trustees of a school district or the H.B.ANo.A8 governing body of an open-enrollment charter school may consider the dates of religious holy days or periods of observance likely to be observed by the students enrolled in the district or school during the [period set by the State Board of Education for the administration of] assessment administration schedule window [instruments required] under Section 39.02301(i) [39.023] in establishing:
(e-1)AANothing in this section has the effect of prohibiting H.B.ANo.A8 the administration of an end-of-course assessment instrument listed in Section 39.023(c) to a student enrolled below the high school level who is enrolled in the course for which the assessment H.B.ANo.A8 instrument is adopted or developed.
The commissioner shall adopt rules necessary to ensure that the student’student s performance on the assessment instrument is considered in the same manner for purposes of this section as the performance of a student enrolled at the high school level.
