A556.0056.AARESTRICTION ON USE OF PUBLIC FUNDS BY POLITICAL SUBDIVISIONS FOR LOBBYING ACTIVITIES.
1-23 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
(a) A political subdivision may not spend public funds:
1-24 SECTIONA1.AAChapter 556, Government Code, is amended by 1-25 adding Section 556.0056 to read as follows:
(1)AAto hire or contract with an individual required to register as a lobbyist under Chapter 305 for the purpose of lobbying a member of the legislature;
1-26 Sec.A556.0056.AARESTRICTION ON USE OF PUBLIC FUNDS BY 1-27 POLITICAL SUBDIVISIONS FOR LOBBYING ACTIVITIES.
or (2)AAto pay a nonprofit association or organization that:
(a) A political 1-28 subdivision may not spend public funds:
(A)AAprimarily represents political subdivisions;
1-29 (1)AAto hire or contract with an individual required to 1-30 register as a lobbyist under Chapter 305 for the purpose of lobbying 1-31 a member of the legislature;
and (B)AAhires or contracts with an individual required to register as a lobbyist under Chapter 305.
or 1-32 (2)AAto pay a nonprofit association or organization 1-33 that:
(b) AASubsection (a) does not apply to an association or organization that solely represents elected sheriffs or individual law enforcement officers.
1-34 (A) AAprimarily represents political subdivisions;
(c) AASubsection (a) does not prohibit:
1-35 and 1-36 (B) AAhires or contracts with an individual 1-37 required to register as a lobbyist under Chapter 305.
(1)AAan officer or employee of a political subdivision from providing information for a member of the legislature or S.B.ANo.A13 appearing before a legislative committee;
1-38 (b)AASubsection (a) does not apply to an association or 1-39 organization that solely represents elected sheriffs or individual 1-40 law enforcement officers.
(2)AAan elected officer of a political subdivision from advocating for or against or otherwise influencing or attempting to influence the outcome of legislation pending before the legislature while acting as an officer of the political subdivision;
1-41 (c)AASubsection (a) does not prohibit:
(3)AAan employee of a political subdivision from advocating for or against or otherwise influencing or attempting to influence the outcome of legislation pending before the legislature if those actions would not require a person to register as a lobbyist under Chapter 305;
1-42 (1)AAan officer or employee of a political subdivision 1-43 from providing information for a member of the legislature or 1-44 appearing before a legislative committee;
(4)AAa political subdivision from reimbursing an officer or full-time employee of the political subdivision for direct travel expenses incurred by the officer or employee for engaging in an activity described by Subdivision (1), (2), or (3);
1-45 (2)AAan elected officer of a political subdivision from 1-46 advocating for or against or otherwise influencing or attempting to 1-47 influence the outcome of legislation pending before the legislature 1-48 while acting as an officer of the political subdivision;
or (5)AAa full-time employee of a nonprofit association or organization that primarily represents political subdivisions of this state from:
1-49 (3)AAan employee of a political subdivision from 1-50 advocating for or against or otherwise influencing or attempting to 1-51 influence the outcome of legislation pending before the legislature 1-52 if those actions would not require a person to register as a 1-53 lobbyist under Chapter 305;
(A)AAproviding legislative services related to bill tracking, bill analysis, and legislative alerts;
1-54 (4)AAa political subdivision from reimbursing an 1-55 officer or full-time employee of the political subdivision for 1-56 direct travel expenses incurred by the officer or employee for 1-57 engaging in an activity described by Subdivision (1), (2), or (3);
(B)AAcommunicating directly with a member of the legislature to provide information if the communication would not require a person to register as a lobbyist under Chapter 305;
1-58 or 1-59 (5)AAa full-time employee of a nonprofit association or 1-60 organization that primarily represents political subdivisions of 1-61 this state from:
or (C)AAtestifying for or against legislation before the legislature.
S.B.ANo.A13 2-1 (A)AAproviding legislative services related to 2-2 bill tracking, bill analysis, and legislative alerts;
(d) AAIf a political subdivision engages in an activity prohibited by Subsection (a), a taxpayer or resident of the S.B.ANo.A13 political subdivision is entitled to appropriate injunctive relief to prevent further activity prohibited by that subsection and further payment of public funds related to that activity.
2-3 (B) AAcommunicating directly with a member of the 2-4 legislature to provide information if the communication would not 2-5 require a person to register as a lobbyist under Chapter 305;
(e) AAA taxpayer or resident who prevails in an action under Subsection (d) is entitled to recover from the political subdivision the taxpayer s or resident s reasonable attorney’ s fees and costs incurred in bringing the action.
or 2-6 (C) AAtestifying for or against legislation before 2-7 the legislature.
SECTIONA2.AASection 89.002, Local Government Code, is amended to read as follows:
2-8 (d)AAIf a political subdivision engages in an activity 2-9 prohibited by Subsection (a), a taxpayer or resident of the 2-10 political subdivision is entitled to appropriate injunctive relief 2-11 to prevent further activity prohibited by that subsection and 2-12 further payment of public funds related to that activity.
Sec.
2-13 (e)AAA taxpayer or resident who prevails in an action under 2-14 Subsection (d) is entitled to recover from the political 2-15 subdivision the taxpayer ’s or residents reasonable attorney’ s fees 2-16 and costs incurred in bringing the action.

2-17 SECTIONA2.AASection 89.002, Local Government Code, is 2-18 amended to read as follows:
(a) Except as provided by Section 556.0056, Government Code, the [The] commissioners court may spend, in the name of the county, money from the county’s general fund for membership fees and dues of a nonprofit state association of counties if:
2-19 Sec.A89.002.AASTATE ASSOCIATION OF COUNTIES.
(1)AAa majority of the court votes to approve membership in the association;
(a) Except as 2-20 provided by Section 556.0056, Government Code, the [The] 2-21 commissioners court may spend, in the name of the county, money from 2-22 the county’s general fund for membership fees and dues of a 2-23 nonprofit state association of counties if:
(2)AAthe association exists for the betterment of county government and the benefit of all county officials;
2-24 (1)AAa majority of the court votes to approve 2-25 membership in the association;
(3)AAthe association is not affiliated with a labor organization;
2-26 (2)AAthe association exists for the betterment of 2-27 county government and the benefit of all county officials;
and (4)AA[neither the association nor an employee of the association directly or indirectly influences or attempts to influence the outcome of any legislation pending before the legislature, except that this subdivision does not prevent a person from providing information for a member of the legislature or appearing before a legislative committee at the request of the committee or the member of the legislature;
2-28 (3)AAthe association is not affiliated with a labor 2-29 organization;
and S.B.ANo.A13 [(5)]AAneither the association nor an employee of the association directly or indirectly contributes any money, services, or other valuable thing to a political campaign or endorses a candidate or group of candidates for public office.
and 2-30 (4)AA[neither the association nor an employee of the 2-31 association directly or indirectly influences or attempts to 2-32 influence the outcome of any legislation pending before the 2-33 legislature, except that this subdivision does not prevent a person 2-34 from providing information for a member of the legislature or 2-35 appearing before a legislative committee at the request of the 2-36 committee or the member of the legislature;
(b)AAIf any association or organization supported wholly or partly by payments of tax receipts from political subdivisions engages in an activity described by Subsection (a)(4) [or (5)], a taxpayer of a political subdivision that pays fees or dues to the association or organization is entitled to appropriate injunctive relief to prevent any further activity described by Subsection (a)(4) [or (5)] or any further payments of fees or dues.
and 2-37 [(5)]AAneither the association nor an employee of the 2-38 association directly or indirectly contributes any money, 2-39 services, or other valuable thing to a political campaign or 2-40 endorses a candidate or group of candidates for public office.
SECTIONA3.AASection 556.0056, Government Code, as added by this Act, applies only to an expenditure or payment of public funds by a political subdivision that is made on or after the effective date of this Act, including an expenditure or payment of public funds by a political subdivision that is made under a contract entered into before, on, or after the effective date of this Act.
2-41 (b)AAIf any association or organization supported wholly or 2-42 partly by payments of tax receipts from political subdivisions 2-43 engages in an activity described by Subsection (a)(4) [or (5)], a 2-44 taxpayer of a political subdivision that pays fees or dues to the 2-45 association or organization is entitled to appropriate injunctive 2-46 relief to prevent any further activity described by Subsection 2-47 (a)(4) [or (5)] or any further payments of fees or dues.
A contract term providing for an expenditure or payment prohibited by Section 556.0056, Government Code, as added by this Act, is void on the effective date of this Act.
2-48 SECTIONA3.AASection 556.0056, Government Code, as added by 2-49 this Act, applies only to an expenditure or payment of public funds 2-50 by a political subdivision that is made on or after the effective 2-51 date of this Act, including an expenditure or payment of public 2-52 funds by a political subdivision that is made under a contract 2-53 entered into before, on, or after the effective date of this Act.
SECTIONA4.AASection 89.002, Local Government Code, as amended by this Act, applies only to the spending of money by a county from the county’ s general fund that occurs on or after the effective date of this Act.
A 2-54 contract term providing for an expenditure or payment prohibited by 2-55 Section 556.0056, Government Code, as added by this Act, is void on 2-56 the effective date of this Act.
The spending of money by a county from the county s general fund that occurs before the effective date of this Act is governed by the law as it existed immediately before the effective date of this Act, and that law is continued in effect for S.B.ANo.A13 that purpose.
2-57 SECTIONA4.AASection 89.002, Local Government Code, as 2-58 amended by this Act, applies only to the spending of money by a 2-59 county from the county’ s general fund that occurs on or after the 2-60 effective date of this Act.
SECTION A5.AAThis Act takes effect on the 91st day after the last day of the legislative session.
The spending of money by a county from 2-61 the county s general fund that occurs before the effective date of 2-62 this Act is governed by the law as it existed immediately before the 2-63 effective date of this Act, and that law is continued in effect for 2-64 that purpose.
2-65 SECTIONA5.AAThis Act takes effect on the 91st day after the 2-66 last day of the legislative session.
