SUBCHAPTER L.
A418.0431.AAEDUCATIONAL MATERIALS ON IDENTIFYING AND AVOIDING FRAUDULENT CHARITABLE SOLICITATIONS.
DESIGNATION PROGRAM FOR DISASTER RELIEF NONPROFIT ORGANIZATIONS AND FINANCIAL INSTITUTIONS Sec.A418.401.AADEFINITIONS.
The division, in consultation with the consumer protection division of the attorney general’s office, shall create and make available to the public on the respective agencies ’ Internet websites educational materials regarding identifying and avoiding fraudulent charitable solicitations during a disaster.
SECTION A2.02.AAChapter 418, Government Code, is amended by adding Subchapter L to read as follows:
H.B.ANo.A20 SUBCHAPTER L.
VOLUNTARY ACCREDITATION OF DISASTER RELIEF ORGANIZATIONS;
FRAUD HOTLINE Sec.
A418.401.AADEFINITIONS.
(1)AA"Accreditation" means the accreditation issued to a disaster relief organization under this subchapter.
(1)AA"Designation program" means the designation program established under this subchapter.
(2)AA"Accreditation program" means the accreditation program established under this subchapter.

Sec.A418.402.AAVOLUNTARY ACCREDITATION PROGRAM FOR DISASTER RELIEF ORGANIZATIONS.
(a) The attorney general, in consultation with the division, shall establish and administer an accreditation program for nonprofit organizations that solicit and accept donations to provide disaster relief services during a declared disaster.
The purpose of the accreditation program is to assist the public in identifying reputable nonprofit organizations to which the public may donate to support disaster relief efforts.
(b) AAParticipation in the accreditation program is voluntary.
A nonprofit organization is not required to obtain accreditation under the program to solicit or accept donations in response to a declared disaster.
H.B.ANo.A20 Sec.A418.403.AAELIGIBILITY FOR ACCREDITATION.
(a) The attorney general, in consultation with the division and the Texas Nonprofit Council established under Chapter 550, shall by rule establish:
(1)AAeligibility criteria that a nonprofit organization must meet and maintain to qualify for an accreditation;
(2)AAprocedures for evaluating accreditation applications;
(3)AAprocedures for renewal and revocation of accreditations;
and (4)AAprocedures for ensuring the data privacy and security of applicant information.
(b)AAThe attorney general may also consult with the emergency management council for purposes of adopting rules under this section.
A418.404.AAAPPLICATION FOR ACCREDITATION.
A418.402.AADESIGNATION PROGRAM FOR DISASTER RELIEF DONATIONS;
A nonprofit organization may apply for an accreditation in the form and manner prescribed by the attorney general.
DESIGNATION NOT REQUIRED.
Sec.A418.405.AAPUBLIC REGISTRY;
(a) The secretary of state shall establish and administer a designation program for political subdivisions in this state to designate a nonprofit organization or financial institution to solicit and accept donations for disaster relief efforts during a declared disaster threatening the political subdivision.

(b)AAThe purpose of the designation program is to assist the residents of each political subdivision of this state in identifying a reputable nonprofit organization or financial institution to which the residents may donate to support disaster relief efforts during a declared disaster threatening the political subdivision.
(a) The attorney general shall maintain and regularly update a public registry of nonprofit organizations accredited under this subchapter on the attorney general’s Internet website.
(c)AAA nonprofit organization or financial institution is not required to receive a designation under the designation program to solicit or accept donations in response to a declared disaster.
(b) AAThe attorney general shall prescribe and approve a seal that may be used and displayed by a nonprofit organization accredited under this subchapter.
Sec.A418.403.AADESIGNATION APPROVAL.
(c) AAThe attorney general shall ensure the registry H.B.ANo.A20 maintained under Subsection (a) and any materials used by an accredited nonprofit organization to display the seal prescribed by the attorney general under Subsection (b) include a clear and conspicuous statement that accreditation under this subchapter is voluntary and does not constitute this state’s endorsement or approval of the organization.
(a) Each political subdivision in this state shall select and submit to the secretary of state in the manner prescribed by the secretary of state a nonprofit organization or financial institution the political subdivision proposes to designate under this subchapter to solicit and accept disaster relief donations during a declared disaster threatening the political subdivision.
Sec.A418.406.AACONSIDERATION OF ACCREDITATION STATUS IN CERTAIN APPLICATIONS FOR STATE MONEY.
(b) AAThe secretary of state shall develop guidelines for approving a nonprofit organization or financial institution a H.B.ANo.A20 political subdivision submits for designation under Subsection (a).
Notwithstanding any other law, a state or local government entity administering a grant or other program that provides state money to support mitigation, preparedness, response, recovery, or other relief efforts in response to a declared disaster may consider a nonprofit organization ’s accreditation status under this subchapter when evaluating the organization ’s application for state money under the grant or other program.
A418.407.AATRANSPARENCY AND REPORTING.
A418.404.AANOTICE OF DESIGNATION.
The attorney general, in consultation with the division and the Texas Nonprofit Council established under Chapter 550, shall by rule establish reporting and transparency standards for nonprofit organizations accredited under this subchapter.
(a) Each political subdivision shall include in the political subdivision s emergency management plan the name of the nonprofit organization or financial institution approved for designation under the designation program.

SECTIONA2.02.AAAs soon as practicable after the effective date of this Act, the secretary of state shall adopt rules to implement Subchapter L, Chapter 418, Government Code, as added by this article.
A418.409.AAFRAUD HOTLINE.
(a) The attorney general shall operate a telephone hotline during each declared disaster for submission of reports of a suspected:
H.B.ANo.A20 (1)AAfraudulent Internet website or nonprofit organization soliciting charitable donations;
and (2)AAoffense under Section 31.03(e)(4)(H) or 32.61, Penal Code.
(b)AAThe attorney general shall:
(1)AAmaintain a record of each report submitted under this section;
(2)AAreview each submitted report of a suspected fraud to determine whether an investigation is warranted;
(3)AAinvestigate each credible report of a suspected fraud, regardless of the total number of similar complaints submitted;
(4)AArefer any report of a suspected fraud involving a potential criminal offense to an appropriate law enforcement authority;
and (5)AAprovide aggregate, non-identifying information to the public on the number and types of reports submitted through the hotline during each declared disaster after the conclusion of the disaster.
Sec.A418.410.AADATA PRIVACY AND SECURITY.
(a) The attorney general by rule shall ensure any personal or organizational information compiled under this subchapter is:
(1)AAlimited to information necessary to determine a nonprofit organization ’s eligibility for initial accreditation and to maintain accreditation;
and (2)AAcollected in the least intrusive manner possible.
(b) AAThe attorney general shall provide to each nonprofit H.B.ANo.A20 organization applying for accreditation clear notice describing:
(1)AAthe specific types of information collected;
(2)AAthe purposes for which the collected information will be used;
and (3)AAwhether and with whom the collected information will be shared.
(c)AAInformation collected under this subchapter may not be:
(1)AAused for any purpose other than a purpose related to a nonprofit organization s accreditation;
(2)AAsold, rented, or otherwise provided to a third party for commercial purposes;
or (3)AAshared with another governmental entity except as required by law or for a purpose directly related to administration of the accreditation program.
(d)AAThe attorney general shall establish and implement reasonable administrative, technical, and physical protections to maintain the confidentiality, integrity, and availability of information collected under this subchapter, including protections for the secure storage, transmission, and disposal of collected information.
(e)AAThe attorney general shall publish in a publicly accessible location on the attorney general s Internet website a description of the data management practices for the accreditation program, including:
(1)AAthe categories of information collected from each nonprofit organization applicant;
(2)AAauthorized uses of the collected information;
H.B.ANo.A20 (3)AAthe length of time the collected information is retained;
and (4)AAthe measures in place to protect the collected information from unauthorized access or disclosure.
Sec.A418.411.AAREPORT TO LEGISLATURE.
The attorney general shall submit to the legislature an annual report evaluating the operation of the accreditation program under this subchapter, including:
(1)AAthe number of nonprofit organizations accredited;
(2)AAuse and public recognition of the accreditation seal prescribed by the attorney general;
(3)AAany impact the program may have on charitable giving during a declared disaster, to the extent data is available;
(4)AAany impact on nonprofit organizations in this state, including participation rates, administrative burden, and perceived benefits or challenges of accreditation;
and (5)AAlegislative recommendations for improvements to the program.
SECTIONA2.03.AAAs soon as practicable after the effective date of this Act, the attorney general, in consultation with the Texas Division of Emergency Management and the Texas Nonprofit Council established under Chapter 550, Government Code, shall adopt rules to implement Subchapter L, Chapter 418, Government Code, as added by this article.
