RSA 151
151:9-c Health Care Referrals. I. No health care facility licensed under this chapter shall prohibit referrals from independent and outside primary care providers so long as the health care facility and specialist accept the insurance of the patient, pursuant to RSA 151:21, XXI. II. The attorney general shall be empowered to enforce the provisions of this section. Any health care facility that violates this section shall be subject to: (a) A $100,000 civil fine per violation. (b) Loss of nonprofit status under state law, if the health care facility is a nonprofit.
This adds a new section specifying that health care facilities cannot refuse referrals from independent primary care providers if they accept the patient's insurance and outlines penalties for noncompliance.
