(5) "Commission" means the government agency whose membership consists of all states that have enacted this compact, which is known as the Social Work Licensure Interstate Compact Commission, as described in Article X, and which shall operate as an instrumentality of the member states.

ARTICLE VI AUTHORITY OF INTERSTATESOCIAL WORK LICENSURE COMPACT COMMISSION AND MEMBER STATE LICENSING AUTHORITIES (1) This compact, or any rule of the commission, does not limit, restrict, or in any way reduce the ability of a member state to:

A current member of the state licensing authority at the time of appointment who is a regulated social worker or public member of the state licensing authority;

(b) Except as otherwise provided in this compact, venue is proper and judicial proceedings by or against the commission shall be brought solely and exclusively in a court of competent jurisdiction where the principal office of the commission is located.

(b) The commission shall provide a copy of the notice of default to the other member states.
(6) Upon the termination of a state's membership from this compact,Page that45 state shall immediately provide notice to all licensees within that state of such62 termination.CODING:
The terminated state shall continue to recognize all licenses granted pursuant to this compact for a minimum of 6 months after the date of said Page 44 of 61 CODING:

(10)(a) By majority vote as provided by rule, the commission may initiate legal action against a member state in default in the United States District Court for the District of ColumbiaPage or46 the federal district where the commission has its principal offices to enforce compliance with the provisions of the62 compactCODING: and its adopted rules.
The relief sought may include both injunctive relief and damages.

ARTICLE XIV EFFECTIVE DATE, WITHDRAWAL, AND AMENDMENT (1) The compact shall come into effect on the date on whichPage the47 compactof statute62 isCODING: enacted into law in the seventh member state.
(2)(a) On or after the effective date of the compact, the commission shall convene and review the enactment of each of the Page 46 of 61 CODING:

(2)(a) On or after the effective date of the compact, the commission shall convene and review the enactment of each of the first seven charter member states to determine if the statute enacted by each such charter member state is materially different than the model compact statute.
(c) All actions taken for the benefit of the commission or in furtherance of the purposes of the administration of the compact prior to the effective date of the compact or the commission coming into existence shall be considered to be actions of the commission unless specifically repudiated by the commission.Page 48 of 62 CODING:
(d) Any state that joins the compact subsequent to the commission's initial adoption of the rules and bylaws shall be subject to the rules and bylaws as they exist on the date on Page 47 of 61 CODING:

(d) Any state that joins the compact subsequent to the commission's initial adoption of the rules and bylaws shall be subject to the rules and bylaws as they exist on the date on which the compact becomes law in that state.
(4) This compact does not invalidate or prevent any licensure agreement or other cooperative arrangement between a memberPage state49 and a nonmember state that does not conflict with the provisions of this62 compact.CODING:
(5) This compact may be amended by the member states.

(5) This compact may be amended by the member states.
Any amendment to this compact is not effective and binding upon any member state until it is enacted into the laws of all member states.
(2) The provisions of this compact shall be severable and if any phrase, clause, sentence, or provision of this compact is held by a court of competent jurisdiction to be contrary to the constitution of any member state, a state seeking participation in the compact, or of the United states, or the application thereof to any government, agency, person, or circumstance is held to be unconstitutional by a court of competent jurisdiction, the validity of the remainder of this compact and the applicability thereof to any other government, agency, person,Page or50 circumstanceof may62 notCODING: be affected thereby.
(3) Notwithstanding subsection (2), the commission may deny a state's participation in the compact or, in accordance with the requirements of subsection (3) of Article XIII, Page 49 of 61 CODING:

(3) Notwithstanding subsection (2), the commission may deny a state's participation in the compact or, in accordance with the requirements of subsection (3) of Article XIII, terminate a member state's participation in the compact, if it determines that a constitutional requirement of a member state is a material departure from the compact.
(3) Any laws, statutes, regulations, or other legal requirements in a member state in conflict with the compact are supersededPage to51 the extent of the62 conflict.CODING:

(c) Being convicted or found guilty of, regardless of adjudication, or having entered a plea of nolo contendere to, a crime in any jurisdiction which directly relates to the practice of his or her profession or the ability to practice his or her profession.
(g) Knowingly aiding, assisting, procuring, or advising any nonlicensed, nonregistered, or noncertified person to hold himselfPage or57 herselfof out62 asCODING: licensed, registered, or certified under this chapter.
(h) Failing to perform any statutory or legal obligation placed upon a person licensed, registered, or certified under Page 56 of 61 CODING:

(m) Soliciting patients or clients personally, or through an agent, through the use of fraud, intimidation, undue influence, or a form of overreaching or vexatious conduct.
In enforcing this paragraph, upon a finding by the State Surgeon General, the State Surgeon General's designee, or the board that probable cause exists to believe that the licensee, registered intern, or certificateholder is unable to practice the profession because of the reasons stated in this paragraph, the department shall have the authority to compel a licensee, registered intern, or certificateholder to submit to a Page 5859 of 6162 CODING:

(q) Performing any treatment or prescribing any therapy which, by the prevailing standards of the mental health professions in the community, would constitute experimentation onPage human60 subjects,of without62 firstCODING: obtaining full, informed, and written consent.
(r) Failing to meet the minimum standards of performance in professional activities when measured against generally Page 59 of 61 CODING:

(r) Failing to meet the minimum standards of performance in professional activities when measured against generally prevailing peer performance, including the undertaking of activities for which the licensee, registered intern, or certificateholder is not qualified by training or experience.
