What changed in the latest version
33 added · 34 removedPlain-language change summary
The amended version of Bill HB 1499 clarifies the grounds for eviction by specifying that landlords can evict tenants who use someone else’s personal information to rent a unit or have specific criminal convictions, but they cannot evict based on prior convictions disclosed before the tenancy began. Notably, the language regarding eviction based on immigration status has been removed, focusing instead on more serious criminal offenses. This change emphasizes tenant protections while allowing landlords to act on more defined legal grounds, potentially balancing tenant rights with rental property security.

This bill expands the grounds for eviction to include use of another person’s personal identification to obtain or maintain a tenancy, certain criminal convictions forwithin specified timeframes, including improper entry under federal law withinand specifiedother timeframes, felony level offenses, and convictions requiring registration as a sexual offender or offender against children, subject to certain limitations.
The bill also prohibits eviction based on convictions disclosed in writing by the tenant or occupant prior to the tenancy or disclosed through a criminal background check conducted by the landlord prior to the tenancy.
Because the total increase in filings and their distribution across Circuit Court District Divisions cannot be precisely determined, the Branch estimates increased General Fund expenditures of an indeterminable amount of more than $200,000$500,000 and less than $700,000$1,000,000 per year.
