The recent amendment to Bill SB 435 clarifies the role of the zoning board of adjustment in assessing variance requests by defining what constitutes an "unreasonable restriction" on property use. Previously, there was a requirement for applicants to demonstrate hardship in order to receive a variance, which has now been removed. This change matters because it may make it easier for property owners to adapt their properties to better meet their needs without being burdened by stringent requirements. Overall, the amendment aims to provide more flexibility and fairness in zoning decisions.
