142:1 Purpose and Use of the Solid Waste Management Fund.
Such rulemaking shall specifically address the unique circumstances for solid waste management districts or municipalities that own and operate a facility that is subject to RSA 149-149-R:5, R:5, or municipalities that are part of a solid waste district that owns and operates such a facility to ensure that the costs incurred by those municipalities or solid waste management districts are offset consistent with this chapter.

This bill allows solid waste management districts, in addition to municipalities, to pay the solid waste disposal surcharge and to receive reimbursement from the Solid Waste Management Fund.
The Department of Environmental Services states any surcharge payments made by solid waste management districts would be deposited into the Solid Waste Management Fund and that such districts would be eligible for reimbursement of 100% of the surcharge paid from the same fund.
As a result, the Department states the fiscal impact on state revenues and expenditures is expected to be neutral, as any increase in revenue would be offset by a corresponding increase in expenditures from the same fund.
The fiscal impact on municipalities is expected to be neutral.
Solid waste management districts and municipalities would be required to pay the solid waste disposal surcharge;
however, they would be eligible for reimbursement from the Solid Waste Management Fund for amounts paid, resulting in no net fiscal impact.
