This(1) consentshallA bevalidandbindingashealthcare ifprovider, thehealthcare minorfacility, hadhospital, achievedphysician, hernurse, majority,emergency andmedical itservices shallprovider, notor beother subjectperson licensed or authorized to provide healthcare services in this state mayrelyin good faith on the representation of a laterperson disaffirmanceprofessing byto reasonbe serving as temporarycustodian or caregiver of hera minority.person who has not attained the age of majority.
B.(1)(2) Theconsentofaspouse,parent,guardian,oranyotherpersonstandingThe inprovisions a fiduciarycapacityto the minor shall not be necessaryin order to authorize such hospital careor services or medical or surgical careor services,or administration of drugsR.S. to be provided by a physician licensed to practice medicine to such a minor.
A40:1159.4(F) minorand may(G) consentshall toapplyto theany provisionhospital, ofhealthcare medicalfacility, andphysician, mentalor healthhealthcare servicesprovider that relies in good faith on any ofdirection theor followingdecision circumstances:by any person reasonably believed to be authorized and empowered to consent under this Section.
(a)(3)Ahealthcareproviderorhealthcarefacilityrelyingontherepresentations Ifof thea minortemporary iscustodian aor membercaregiver under this Section shall have no affirmative dutyto investigate, verify, or confirm the legal authority of the armedperson forcesprofessing to be serving as temporarycustodian or caregiver of such person who has not attained the Unitedage Statesof majority at the request of America.a parent or legal guardian absent actual knowledge that the representation is false.
(b)B.(1) IfTheconsentofaspouse,parent,guardian,oranyotherpersonstanding in a fiduciarycapacityto the minor isshall emancipated.not be necessaryin order to authorize such hospital careor servicesor medical or surgical care or services, or administration of drugs to be provided by a physician licensed to practice medicine to such a minor.
(c)A Ifperson who has not attained the minorage isof pregnantmajority andmay consentingconsent to medicalthe orprovision surgicalof caremedical orand mental health services relatedin toanyof the pregnancy.following circumstances:

(e) If the minor is seeking medical or surgical care and services for the treatment of sexually transmitted diseases.
(f) If the minor is donating blood.

(h) If a person who has not attained the age of majority voluntarily chooses to be admitted to a treatment facility in accordance with Children's Code Article 1464.
(i) If the person who has not attained the age of majority is enrolled as a student in a college or university, not including a high school student that is dually enrolled in a post-secondaryeducation program.
(j) If the person who has not attained the age of majority is seeking contraceptives or prevention or treatment for a sexually transmitted infection, with the exception of the provision of a vaccination for a sexual transmitted disease or infection.
(2) Consent given by a person who has not attained the age of majority in accordance with this Subsection shall be valid and binding as if the person had achievedhismajority.
Anysuchconsentshall notbesubjecttoalaterdisaffirmance by reason of his minority.

Requires informed, written, parental consent for the provision or performance of certain medical procedures or services to minors.
Present law provides that consent to the provision of medical or surgical careor services by a hospital or public clinic, or to the performance of medical or surgical care or services by a physician, licensed to practice medicine in this state, when executed bya minor who is or believeshimselfto be afflictedwith an illness or disease,shall bevalidandbindingasifthe minor had achieved his majority.
Proposed law repeals present law.
Proposedlawrequiresinformedconsentfromapersonlawfullyexercisingparentalauthority over a minor child for all medical and mental health services provided to the minor child until the minor reaches the age of 17.
Exceptions to the provisions of proposed law include but are not limited to the following instances:
(1) If the minor is a member of the armed forces of the United States of America.
(2) If the minor is emancipated.
(3) Iftheminorispregnantandconsentingtomedicalorsurgicalcareorservicesrelated to the pregnancy.
(4) If the minor is seeking treatment for alcohol or substance misuse.
(5) If the minor is seeking medical or surgical care and services for the treatment of sexually transmitted diseases.
(6) If the minor is donating blood.
(7) If the minor is exhibiting signs of abuse or neglect based on the judgment of a healthcare provider.
(8) If a minor voluntarily chooses to be admitted to a treatment facility in accordance with present law.
