1:13(B) and 24:177(E)] HB 19 Reengrossed 2026 Regular Session Illg Abstract:
Providesrelativetodefinitionsandthepowers,duties,andauthorityoftheboard of trustees for the District Attorneys' Retirement System.
Present law defines "medical board" as the State Medical Disability Board.
Proposed law repeals present law.
Presentlawprovidesthatamemberwhobecomesdisabled,whofilesforadisabilitybenefit while in service, and who upon a medical examination and certification is found to have a total disability for any cause, is entitled to disability benefits as provided in present law.
Requires the member to have 10 years of service credit and that the disability was incurred while the member was an active contributing member in active service.
Provides that if an application for disability was not filed while the member was in active service, it is presumed that the disability was not incurred while the member was an active and contributing member.
Proposed law retains present law.
Present law requires the system board of trustees to award disability benefits to eligible members who have been officially certified as having a disability by the State Medical Disability Board.
Proposed law provides that the official certification of a disability is determined by a physician designated by the board of trustees.
