Proposed law adds a requirement for the commission to include in the recommended requirements and standards of practice the authorityfor certain licensed EMS practitioners to administer patient-carried, time-critical prescription medication to patients with rare diseases, chronic illnesses, and special medical needs.
ProposedlawauthorizesEMSpractitionerstoadministerthemedicationattherequestofthe patient or patient's family and in accordance with protocols established by the EMS practitioner's EMS medical director.
Proposedlawprovidesthatan EMS practitioneractingin accordancewith theprovisions of proposed law shall be immune from civil liability, criminal prosecution, or disciplinary or otheradverseactionunderanyprofessionallicensingstatuteforanyoutcomesresultingfrom theadministrationofthemedication,unlesspersonalinjuryresultsfromthegrossnegligence or willful or wanton misconduct of the EMS practitioner administering the medication.
