Hazardous Waste Site Cleanup Fund A.(1) All sums recovered through judgments, settlements, assessments of civil or criminal penalties, funds recovered by suit or settlement from potentially responsiblepartiesforactiveorabandonedsiteremediationorcleanup,orotherwise under this Subtitle, or other applicable law, each fiscal year for violation of this Subtitle, shall be paid into the state treasury and shall be credited to the Bond SecurityandRedemptionFund.Afterasufficientamountisallocatedfromthatfund to pay all obligations secured by the full faith and credit of the state which become dueandpayablewithin anyfiscalyear,thetreasurer,priortoplacingsuchremaining funds in the stategeneralfund,state generalfund, shall payinto a special fund, which is herebycreated inthestatetreasuryanddesignatedasthe"HazardousWasteSiteCleanupFund",all ofthosefundsgeneratedbythehazardouswastetaxofthosefundsgeneratedbythehazardouswastetaxundertheprovisions undertheprovisions ofChapter 7-AofSubtitle IIofTitleIIof 47oftheLouisianaTitle Revised47 Statutesof theLouisianaRevisedStatutes of1950andthesums recovered through all judgments, settlements, assessments of 1950civil andthesumsor criminal penalties, fees and oversight costs received from potentially responsible parties for Page 1 of 32 CODING:

1:13(B) and 24:177(E)] HB 417 Engrossed 2026 Regular Session Zeringue Abstract:IncreasesthemaximumbalanceoftheHazardousWasteSiteCleanupFundfrom $6M to $8M and requires annual adjustments of the maximum balance by the percentage increases in the Consumer Price Index (CPI-U).
PresentlawestablishestheHazardousWasteSiteCleanupFund(fund),whichreceivessums from the hazardous waste tax and sums recovered from judgements, settlements, and assessed civil and criminal penalties from parties responsible or potentially responsible for active or abandoned site remediation or cleanup.
Further requires monies in the fund to be usedforpurposeswhichincludesfundingtheoperatingexpensesofinactiveandabandoned sites activities, defrayingcostsassociatedwith hazardous waste sites, such as investigation, testing, containment, quarantining, control, and cleanup, and matching funds for federal grants.
