Provides for automatic reinstatement of suspended, cancelled, and revoked driver's licenses upon full payment of department fees and proof of payment of traffic fines.
Present law (R.S.
32:414(F)(2)) authorizes the Dept.
of Public Safety and Corrections (DPS&C), office of motor vehicles (OMV), to suspend, cancel, or revoke driver's licenses for cause satisfactoryto the dept.
for a period of not more than one year.
Proposed law retains present law and requires that any license suspended, cancelled, or revoked for nonpayment of fees be automaticallyreinstated if both of the following occur:
(1) The person makes full payment of all fees and fines assessed bythe DPS&C, OMV, that resulted in the suspension, cancellation, and revocation of the license.
(2) The person provides proof of payment of any fees or fines pursuant to the requirements of present law.
Further provides for an exception that proposed law not apply to a person whose driver's license suspended, cancelled, or revoked for operatinga vehicle while impaired.
Present law (R.S.
32:415(B)(1)(a)) requires any period of suspension or revocation be automaticallyextended for a period of one year from the date the licensee would otherwise have been entitled to applyfor a new license upon his conviction for any offense involving the operation of a motor vehicle committed during such period.
Further requires that no driver can use a license issued to him in another state or the privilege of a nonresident to drive a vehicle in this state, upon receivingnotice of his conviction, or of the entryof a plea of guilty and sentence, or of the forfeiture of bail in another state of federal jurisdiction for anyoffense,whichifcommittedinthisstate,wouldbegroundsforsuspensionorrevocation of the license.
