disabilities State of Arizona House of Representatives Fifty-seventh Legislature Second Regular Session HOUSE BILL 2240 AN ACT AMENDING SECTION 15-1808, ARIZONA REVISED STATUTES;
Deletes the requirement that the Arizona Board of Regents (ABOR) and a community college district provide the eligible child or dependent of a member or former member of the United States Armed Forces a tuition waiver scholarship as prescribed.
AMENDING TITLE 15, CHAPTER 14, ARTICLE 1, ARIZONA REVISED STATUTES, BY ADDING SECTION 15-1809.03;

APPROPRIATING MONIES;
Establishes the Dependents of Military Personnel Tuition Scholarship Fund (Fund) that is administered by ABOR and authorizes ABOR to provide a tuition scholarship to the eligible child or dependent of a member or former member of the United States Armed Forces as specified.

Appropriates $15,000,000 from the state General Fund in FY 2027 to the Fund.
2240 Be it enacted by the Legislature of the State of Arizona:

Specifies requirements relating to Fund monies.
5.
Requires ABOR, subject to available monies, to use Fund monies to award tuition scholarships on a first-come, first-served basis to any individual who:
a.
is the child or dependent of a member or former member of the United States Armed Forces who:
i.
has a disability rating of at least 30%;
and ii.
is either an Arizona resident or was stationed in Arizona at the time of the injury that resulted in the disability rating;
b.
provides documentation verifying they meet the eligibility requirements;
c.
is enrolled full-time at an Arizona public university or community college;
d.
completed and submitted the Free Application for Federal Student Aid;
e.
is an Arizona resident;
f.
has not been convicted of a felony;
and g.
has not obtained a total number of postsecondary education credits that meets or exceeds the number of credits required for baccalaureate degree for the individual's initially declared course of study.
6.
Prohibits ABOR from awarding a tuition scholarship:
a.
to any individual for more than four academic years or eight semesters;
and b.
if there are insufficient Fund monies, awarding a tuition scholarship to an eligible individual.
7.
Caps a tuition scholarship at the actual cost of in-state tuition and fees minus other financial gifts, grants or aid.

A district as defined in section 15-1401, after verification by the Arizona peace officers memorial board, by the Arizona fallen firefighter memorial committee, by the adjutant general of the national guard or by the Arizona department of veterans' services that a person is the child or the spouse of a peace officer, correctional officer, firefighter, emergency paramedic, national guard member or member of the United States armed forces who was a resident of Arizona or stationed in Arizona and who was killed in the line of duty or who died from injuries suffered in the line of duty while traveling to or from duty, shall provide the person who qualifies under subsection D of this section and who otherwise meets the House Amendments to H.B.

A member of the Arizona national guard who received a purple heart citation on or after September 11, 2001 or a former member of the Arizona national guard who was medically discharged from the Arizona national guard due to an injury or disability suffered during status under title 10, United States Code, in weekend training status, in annual training status or in response to a state of emergency declared by the governor is eligible for a tuition waiver scholarship provided for in this section.

IS THIRTY YEARS OF AGE OR YOUNGER.
2.
HAS NOT BEEN CONVICTED OF A FELONY.
3.
MEETS THE QUALIFICATIONS FOR ADMISSION AT THE UNIVERSITY OR COMMUNITY COLLEGE.
4.
HAS NOT OBTAINED MORE THAN SIXTY-FOUR CREDIT HOURS AT COMMUNITY COLLEGES IN THIS STATE.

"Peace officer" means a county sheriff, a constable, a marshal, a police officer of a city or town, an individual who is commissioned by the department of public safety and a police officer who is appointed by a community college district governing board or the Arizona board of regents who received a certificate from the Arizona peace officer standards and training board, and any other state, federal, tribal, city or county -4- House Amendments to H.B.
