And except as provided by paragraph 2 of this subsection, the penalty imposed on a taxpayer that fails to make and file a return for tax administered pursuant to chapter 5 or 6 of this title on or before the due date of the return or the due date as extended by the department, unless it is shown that the failure is due to a reasonable cause and not due to wilful neglect OR THE TAX REQUIRED TO BE SHOWN ON THE RETURN IS ZERO, is four and one-half percent of the tax required to be shown on the return, or $25, whichever is greater.
