(a) A person commits the offense of selling or giving tobacco to a person under 21 years of age [MINOR] if the person (1) negligently sells a cigarette, a cigar, tobacco, or a pruodtproduct containing tobacco to a person under 21 [19] years of age;

(a) Except as provided in (e) of this section, a[A]a [A] person under 21 [19] years of age may not knowingly possess a cigarette, a cigar, tobacco, a product containing tobacco, an electronic smoking product, or a product containing nicotine in this state.
[THIS SUBSECTION DOES NOT APPLY TO A PERSON WHO IS A PRISONER AT AN ADULT CORRECTIONAL FACILITY.] Enrolled SB 24 -2- (b) In a prosecution under (a) of this section for possession of an electronic SB 24 -2- SB0024A New Text Underlined [DELETED TEXT BRACKETED] 34-LS0260\N smoking product or a product containing nicotine, it is an affirmative defense that the electronic smoking product or product containing nicotine possessed by the person under 21 [19] years of age was intended or expected to be consumed without being combusted, and the electronic smoking product or product containing nicotine (1) has been approved by the United States Food and Drug Administration for sale as a tobacco use cessation [OR HARM REDUCTION] product or for other medical purposes;
(c) Possession of tobacco, an electronic smoking product, or a product containing nicotine by a person under 21 years of age [MINOR] is a violation punishable by a fine of not more than $300.$100.
Notwithstanding AS 12.55.035(b), in place of any fine imposed for the violation of this subsection,section, the court may refer a defendant, at the request of the defendant, to a tobacco education program.
(d) The supreme court shall establish by rule or order a schedule of bail amounts that may be forfeited without court appearance for a violation of this sectionsection. by a person 19 or 20 years of age.
(e) The supremeprovisions court,of in(a) establishingof scheduledthis amountssection ofdo bailnot underapply thisto section,a mayperson not19 allowor for20 dispositionyears of anage offensewho withoutis courtemployed appearanceby for a person with a business license endorsement under 18AS years43.70.075 and, as part of agethat whoemployment, is citedselling fora cigarette, a violationcigar, oftobacco, thisa section.product containing tobacco, an electronic smoking product, or a product containing nicotine.
(f) The provisions of (a) of this section do not apply to a person 19 or 20 years of age who is employed by a person with a business license endorsement under AS 43.70.075 and, as part of that employment, is selling a cigarette, a cigar, tobacco, a product containing tobacco, an electronic smoking product, or a product containing SB0024A -3- SB 24 New Text Underlined [DELETED TEXT BRACKETED] 34-LS0260\N nicotine.
(b) Subsection (a) does not apply if the sale -3- Enrolled SB 24 (1) is by vending machine as provided under AS 11.76.100(b) or 11.76.109(d);
(b) The provisions of (a) of this section do not apply to the sale, exchange, or gift to a person under 21 [19] years of age of an electronic smoking product or a SB 24 -4- SB0024A New Text Underlined [DELETED TEXT BRACKETED] 34-LS0260\N product containing nicotine that is intended or expected to be consumed without being combusted if the electronic smoking product or product containing nicotine (1) has been approved by the United States Food and Drug Enrolled SB 24 -4- Administration for sale as a tobacco use cessation [OR HARM REDUCTION] product or for other medical purposes;
(g) Selling or giving an electronic smoking product or a product containing SB0024A -5- SB 24 New Text Underlined [DELETED TEXT BRACKETED] 34-LS0260\N nicotine to a person under 21 years of age [MINOR] is a violation and, upon conviction, is punishable by a fine of not less than $300.
-5- Enrolled SB 24 (71) "nicotine" includes a chemical or chemical compound intended, when introduced into the human body, to mimic or simulate the effect of nicotine from tobacco.
AS 29.35.085(c)18.35.301(i) is amended by adding a new paragraph to read:

(B) does not allow cigarettes or cigarette tobacco on the premises;
and (C) contains a walk-in or stand-up humidor as a built-in feature on the premises.
AS 18.35.301 is amended by adding a new subsection to read:
(j) Notwithstanding (a) and (b) of this section, unless the owner or operator prohibits it, an individual may smoke at a retail cigar store that (1) that is in a building that (A) is freestanding;
or (B) if it is attached to another business or building, (i) has a separate entrance;
(ii) is separated from the other business or building in a manner that does not allow cigar aerosols to travel into the other business or building;
and (iii) the other business or building does not serve as a residence, child care facility, facility providing care for adults on a fee- for-service basis, school, or health care facility;
(2) where smoking is limited to the smoking of cigars;
(3) that is not (A) a business that is licensed under AS 05.15 to sell pull-tabs;
or (B) a retail store that is within an indoor public place or workplace.

Excise tax levied.
An excise tax is levied on tobacco products, synthetic nicotine products, and nicotine substitutes in the state at the rate of 75 percent of the wholesale price of the tobacco products.
The tax is levied when a person (1) brings, or causes to be brought, a tobacco product, synthetic nicotine product, or nicotine substitute into the state from outside the state for sale;
(2) makes, manufactures, or fabricates a tobacco product, synthetic nicotine product, or nicotine substitute in the state for sale in the state;
or (3) ships or transports a tobacco product, synthetic nicotine product, or nicotine substitute to a retailer in the state for sale by the retailer.

(c) A common or contract carrier may not knowingly transport a tobacco productproduct, synthetic nicotine product, or nicotine substitute to a person in this state unless the person (1) shipping the tobacco product is licensed under this chapter and, before shipment, provides the common or contract carrier withverifies athe copyage of the person's current license issued by the department and (A) an affidavit from the intended recipient certifyingas that21 theyears personof receivingage theor tobaccoolder productbefore isdelivery; a person described under (b)(1) - (4) of this section;
or (B)Enrolled SB 24 -10- (2) the commonperson receiving the tobacco product, synthetic nicotine product, or contractnicotine carriersubstitute verifiesis thea ageperson ofdescribed theunder recipient(a)(2), as(3), 21or years(4) of agethis section or olderis licensed under this chapter and, before delivery;receipt, provides the common or contract carrier with a copy of the person's current license issued by the department.
or(d) (2)If receivinga the tobacco productproduct, issynthetic anicotine personproduct, describedor undernicotine (a)(2)substitute oris (3)transported ofby thisa sectioncommon or iscontract licensedcarrier underto thisa chapterhome and,or beforeresidence, receipt,it providesis rebuttably presumed that the common or contract carrier withknew that the recipient of the tobacco product, synthetic nicotine product, or nicotine substitute was not a copyperson described under (b)(1) - (5) of this section, unless the person'scommon currentor licensecontract issuedcarrier byhas satisfied the department.requirement in (c)(1) of this section.
(d)(e) IfA aperson, tobaccoother productthan is transported by a common or contract carriercarrier, tomay not knowingly transport a hometobacco orproduct, residence,synthetic itnicotine isproduct, rebuttablyor presumednicotine thatsubstitute theto commona orperson contractin carrierthis knewstate, thatunless the recipient of the tobacco productproduct, wassynthetic notnicotine aproduct, personor describednicotine undersubstitute (b)(1)is -a (5) of this section, unless the person shippingdescribed theunder tobacco(a)(4) productor has(b)(1) satisfied- the(5) requirements in (c)(1) of this section.
(e)(f) A person,person otherwho thanships aor commoncauses orto contractbe carrier,shipped maya nottobacco knowinglyproduct, SB0024Asynthetic -9-nicotine SBproduct, 24or Newnicotine Textsubstitute Underlinedto [DELETEDa TEXTperson BRACKETED]in 34-LS0260\Nthis transportstate ashall tobaccoplainly productand tovisibly amark personthe incontainer thisor state,wrapping unlesswith the recipientwords of"product containing nicotine" if the tobacco productproduct, synthetic nicotine product, or nicotine substitute is shipped in a personcontainer describedor underwrapping (b)(1)other -than (5)the manufacturer's original container or wrapping of thisthe section.tobacco product, synthetic nicotine product, or nicotine substitute.
(f)(g) A person who shipsviolates orthe causesprovisions toof bethis shippedsection ais tobaccoguilty productof to a personclass inA thismisdemeanor state shall plainly and visibly mark the container or wrapping with the words "tobacco product" if the tobaccoperson productunlawfully isships, shippedcauses into abe containershipped, or wrappingtransports othera thantobacco theproduct, manufacturer'ssynthetic originalnicotine containerproduct, or wrappingnicotine ofsubstitute. the tobacco product.
(g) A person who violates the provisions of this section is guilty of a class A misdemeanor if the person unlawfully ships, causes to be shipped, or transports a tobacco product.

AS 43.50.390(1) is amended to read:
(1) "distributor" means a person who (A) brings, or causes to be brought, a tobacco product, synthetic nicotine product, or nicotine substitute into the state from outside the state for sale;
(B) makes, manufactures, or fabricates a tobacco product, synthetic nicotine product, or nicotine substitute in the state for sale in the state;
or (C) ships or transports a tobacco product, synthetic nicotine product, or nicotine substitute to a retailer in the state for sale by the retailer;

(4) "tobacco product" means (A) a cigar;
(B) a cheroot;
(C) a stogie;
(D) a perique;
(E) snuff and snuff flour;
(F) smoking tobacco, including granulated, plug-cut, crimp-cut, ready-rubbed, and any form of tobacco suitable for smoking in a pipe or cigarette;
(G) chewing tobacco, including cavendish, twist, plug, scrap, and tobacco suitable for chewing;
or (H) an article or product made of tobacco, [OR] a tobacco substitute, or synthetic tobacco, but not including a cigarette as defined in AS 43.50.170;

(b) A licensee located in the state shall collect and remit the tax to the Enrolled SB 24 -12- department.
(B) approved for sale by the United States Food and Drug Administration as a drug, drug product, including a drug product used to treat SB 24 -10- SB0024A New Text Underlined [DELETED TEXT BRACKETED] 34-LS0260\N tobacco dependence, or combination product under 21 U.S.C.
(b) In this section, (1) "hemp" andor "hemp products"product" meanmeans hemp or a hemp product produced by an individual registered under AS 03.05.076;
(b) The department, upon application and payment of a fee of $50, shall issue -13- Enrolled SB 24 a license for one year to a person who applies for a license under (a) of this section.
(d) A license issued under this section must include the nameandname and address of the licensee, the type of business to be conducted, and the year for which the license is SB0024A -11- SB 24 New Text Underlined [DELETED TEXT BRACKETED] 34-LS0260\N issued.
Enrolled SB 24 -14- Sec.
A licensee shall keep a complete and accurate record of all electronic smoking products of the licensee, including purchase prices, sales prices, the names and addresses of the sellers, the dates of delivery, the quantities of SB 24 -12- SB0024A New Text Underlined [DELETED TEXT BRACKETED] 34-LS0260\N electronic smoking products, and the trade names and brands.

(e) A person, other than a common or contract carrier, may not knowingly transport an electronic smoking product to a person in this state, unless the recipient of Enrolled SB 24 -16- the electronic smoking product is a person described under (b)(1) - (5) of this section.

A person may sell or distribute to consumers in this state, acquire, hold, own, possess, or transport for sale or distribution in this state, or import or cause to be imported into this state for sale or distribution in this state only electronic smoking products (1) for which the component vapor product (A) has a nicotine content of not more than 5070 milligrams of nicotine for each milliliter of vapor product;
and (3) that are labeled to inform consumers about all vapor product ingredients and nicotine content.content, including the nicotine concentration in milligrams per milliliter and the total amount of milligrams of nicotine in the product.

In AS 43.50.850 - 43.50.900, "sales price" (1) "retailer" means thea totalperson amountin ofthe consideration,state includingwho cash, credit, property, and services, for which an electronic smoking product is purchasedengaged or sold, valued in money, whether received in money or otherwise, without any deduction for (A) the seller'sbusiness cost of theselling electronic smoking productproducts sold;at retail;
(B)(2) "sales price" (A) means the costtotal amount of materialsconsideration, used,including laborcash, credit, property, and services, for which an electronic smoking product is purchased or servicesold, cost,valued interest,in losses,money, costwhether ofreceived transportation,in taxes,money or otherotherwise, expenseswithout any deduction for (i) the seller's cost of the seller;electronic smoking product sold;
(C)(ii) chargesthe bycost theof sellermaterials forused, serviceslabor necessaryor toservice completecost, interest, losses, cost of transportation, taxes, or other expenses of the sale;seller;
(D)(iii) deliverycharges charges;by the seller for services necessary to complete the sale;

(ii) interest, financing, and (C)carrying taxescharges legallyfrom imposedcredit directlyextended on the consumersale thatof arean electronic smoking product if the amount is separately stated on the invoice, bill of sale, or similar document given to the purchaser.purchaser;
and (iii) taxes legally imposed directly on the consumer that are separately stated on the invoice, bill of sale, or similar document given to the purchaser.
Enrolled SB 24 -18- (2) "electronic smoking product" (A) includes (i) a product that can be used to deliver aerosolized or vaporized nicotine to the person inhaling;
(B) does not include a (i) battery, battery charger, heating element, electronic SB 24 -16- SB0024A New Text Underlined [DELETED TEXT BRACKETED] 34-LS0260\N coil, or mouthpiece intended for use in an electronic smoking product, when sold separately from the electronic smoking product;
(4) "retailer""vapor product" means a personsubstance inintended theto statebe whoaerosolized isor engagedvaporized induring the businessuse of sellingan electronic smoking productsproduct. at retail;
(5) "vapor product" means a substance intended to be aerosolized or vaporized during the use of an electronic smoking product.
20.26.
"The sale of electronic smoking products or products containing nicotine without a prescription or tobacco products to persons under age 21 [19] is illegal." A person holding an endorsement issued under this section shall display the warning sign in a manner conspicuous to a person purchasing or consuming tobacco products, -19- Enrolled SB 24 electronic smoking products, or products containing nicotine on the licensed premises.
21.27.
If a hearing is requested under this subsection, an administrative SB0024A -17- SB 24 New Text Underlined [DELETED TEXT BRACKETED] 34-LS0260\N law judge of the office of administrative hearings (AS 44.64.010) shall determine the issues by using the preponderance of the evidence test and shall, to the extent they do not conflict with regulations adopted under AS 44.64.060, conduct the hearing in the manner provided by regulations of the department.
(3) within the 24 months before the date of the department's notice under this subsection, was the person, or an agent or employee of the person while acting within the scope of the agency or employment of the person, convicted of violating AS 11.76.100, 11.76.106, 11.76.107, or 11.76.109 or adjudicated for Enrolled SB 24 -20- violating a provision of (a) or (g) of this section;
(B) previously violated AS 11.76.100, 11.76.106, 11.76.107, or 11.76.109 at a location or outlet in a location for which the person holds a business license endorsement, or had an agent or employee previously violate SB 24 -18- SB0024A New Text Underlined [DELETED TEXT BRACKETED] 34-LS0260\N AS 11.76.100, 11.76.106, 11.76.107, or 11.76.109;
22.28.
(2) informed the person's agents and employees of the applicable laws -21- Enrolled SB 24 and their requirements and conducted training on complying with the laws and requirements;
