The recent amendment to bill SB 2379 clarifies the process for surveying land needed for public use. Specifically, it now requires the surveying party to notify the landowner through certified mail, detailing the project’s name, timeline, and scope, and prohibits them from surveying until 30 days after this notification, unless consent is granted sooner. This change is important as it aims to ensure that landowners are adequately informed and have a fair amount of time to respond before any surveying occurs, thereby protecting their rights during eminent domain proceedings.
