The bill amends existing law by allowing the President to impose sanctions related to investments in countries of concern and enhances reporting requirements regarding these investments.
-
50 U.S.C. 1701
The President may exercise all of the powers granted to the President under the International Emergency Economic Powers Act (50 U.S.C. 1701 et seq.) to the extent necessary to prohibit any United States person from investing in or purchasing significant amounts of equity or debt instruments of a foreign person that is determined to be a covered foreign person.
This addition enables the President to impose sanctions specifically targeting investments in foreign entities associated with national security threats.
-
50 U.S.C. 1705
The penalties provided for in subsections (b) and (c) of section 206 of the International Emergency Economic Powers Act (50 U.S.C. 1705) shall apply to any person who violates, attempts to violate, conspires to violate, or causes a violation of any prohibition of this section, or an order or regulation prescribed under this section, to the same extent that such penalties apply to a person that commits an unlawful act described in section 206(a) of such Act (50 U.S.C. 1705(a)).
This change aligns the penalties for violations of new sanctions under the bill with existing violations under the International Emergency Economic Powers Act.
-
50 U.S.C. § 3091
Sanctions under this section shall not apply with respect to any activity subject to the reporting requirements under title V of the National Security Act of 1947 (50 U.S.C. 3091 et seq.); or any authorized intelligence activities of the United States.
This section clarifies that intelligence activities are exempt from the new sanctions imposed under this bill.
