DAW S00661'25_SB0807_INTR_1S00661'25_SB807_APS_1 1fnr7tw8o0xz THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
(h) "IRA" means an individual retirement account under section DAW S00661'25_SB0807_INTR_1S00661'25_SB807_APS_1 1fnr7tw8o0xz 1 408 of the internal revenue code, 26 USC 408, or a Roth IRA under section 408A of the internal revenue code, 26 USC 408A.
The fund must be operated in a manner determined by the board so that the accounts of enrollees established under the program meet the requirements for IRAs under the internal revenue DAW S00661'25_SB0807_INTR_1S00661'25_SB807_APS_1 1fnr7tw8o0xz 1 code.
DAW S00661'25_SB0807_INTR_1S00661'25_SB807_APS_1 1fnr7tw8o0xz 1 (a) For the exclusive purposes of providing benefits to enrollees and defraying reasonable expenses of administering the program.
DAW S00661'25_SB0807_INTR_1S00661'25_SB807_APS_1 1fnr7tw8o0xz 1 (c) Contract as necessary for the administration of the program and fund, including, but not limited to, retaining and contracting with investment managers, private financial institutions, other financial and service providers, consultants, actuaries, counsel, auditors, third-party administrators, and other professionals.
(i) Accept any grants, appropriations, or other money from this state, any unit of federal, state, or local government, or any other person, firm, partnership, or corporation solely for deposit DAW S00661'25_SB0807_INTR_1S00661'25_SB807_APS_1 1fnr7tw8o0xz 1 into the fund, whether for investment or administrative purposes.
(q) Deposit into the secure retirement administrative fund all grants, gifts, donations, fees, and earnings from investments from DAW S00661'25_SB0807_INTR_1S00661'25_SB807_APS_1 1fnr7tw8o0xz 1 the fund that are used to recover administrative costs.
(2) The investment manager or managers shall provide the reports the board considers necessary for the board to oversee each DAW S00661'25_SB0807_INTR_1S00661'25_SB807_APS_1 1fnr7tw8o0xz 1 investment manager's performance and the performance of the fund.
DAW S00661'25_SB0807_INTR_1S00661'25_SB807_APS_1 1fnr7tw8o0xz 1 (c) How to opt out of the program.
DAW S00661'25_SB0807_INTR_1S00661'25_SB807_APS_1 1fnr7tw8o0xz 1 The level may be expressed as a percentage of wages or as a dollar amount up to the deductible amount for the enrollee's taxable year under section 408A(c) of the internal revenue code, 26 USC 408A.
The website must be available to the public before the board opens DAW S00661'25_SB0807_INTR_1S00661'25_SB807_APS_1 1fnr7tw8o0xz 1 the program for enrollment, and the website address must be included on any website posting or other materials regarding the program offered to the public by the board.
(2) If a participating employer or its agent willfully fails to remit any portion of an employee contribution in the time period specified in this subsection, the employer and all agents DAW S00661'25_SB0807_INTR_1S00661'25_SB807_APS_1 1fnr7tw8o0xz 1 responsible for the nonremission are guilty of a misdemeanor punishable by a fine of not more than $5,000.00.

(5) Civil fines collected under this act and fees collected under subsection (6) must be deposited into the secure retirement DAW S00661'25_SB0807_INTR_1S00661'25_SB807_APS_1 1fnr7tw8o0xz 1 administrative fund.
This subsection does not prohibit the board or treasurer or any authorized delegate from publishing or DAW S00661'25_SB0807_INTR_1S00661'25_SB807_APS_1 1fnr7tw8o0xz 1 making available to the public reasonable statistics concerning the operation of this act in which the contents of returns are grouped into aggregates in a way that the specific information of any employer is not disclosed.
The department, on behalf of the board, may, for any purpose consistent with the DAW S00661'25_SB0807_INTR_1S00661'25_SB807_APS_1 1fnr7tw8o0xz board's fiduciary duty to participants, enter into agreements with other states that offer auto-IRA retirement programs.
