Summary

Section 11.215(6) of 17 Pa. Code (relating to weapons and hunting) provides that the activity of trapping is prohibited without the written permission of the Department of Conservation and Natural Resources (Department) Bureau of State Parks unless the activity takes place in an area designated by the Department for hunting. In the hunting areas where trapping is permitted, the Department will place the following restriction on trapping to enhance visitor safety and minimize recreational user conflict. Specifically, the Department will prohibit the placement of traps within 50 feet from the edge of trails, pathways, sidewalks, roads (paved and unpaved), administrative roads and parking lots in State parks and preserves. The prohibition will be enforced under 17 Pa. Code § 11.208(k)(2) (relating to schedule; closure). Using or engaging in activities in a State park, area or facility in violation of a restriction or prohibition under subsection (h) or subsection (i) is prohibited, unless permitted by the Department. The Department is responsible for protecting natural resources, maintaining public safety and preventing recreational user conflicts. By implementing the 50-foot trapping buffer, the Department will be able to better minimize recreational user conflicts.
