I.D. No. EDU-30-26-00006-E Filing No. 970 Filing Date: 2026-10-09 Effective Date: 2026-10-12 PURSUANT TO THE PROVISIONS OF THE State Administrative Pro- cedureAct, NOTICE is hereby given of the following action: Action taken: Addition of section 59.17 to Title 8 NYCRR. Statutory authority: Education Law, sections 101, 207, 6506 and 6507 Finding of necessity for emergency rule: Preservation of public health and general welfare. Specific reasons underlying the finding of necessity: In the past, New York has authorized limited forms of temporary practice by out-of-state professionals in circumstances where doing so serves an important public purpose, including addressing healthcare workforce shortages, supporting large-scale events, and increasing access to services for underserved populations. Recently, pursuant to Executive Orders issued in response to healthcare staffing shortages, individuals licensed and in good standing in other states were temporarily authorized to practice in New York. Under this authority charitable organizations have collaborated to provide much needed dental services to underserved New York State residents. This year, however, the event may no longer take place under the authority of an EO because the EO utilized to grant such authority has expired. Accordingly, and consistent with the State’s prior use of limited practice authorizations to address identified public needs, the Department proposes to establish a Temporary Charitable Practice authorization. This authoriza- tion would permit individuals licensed and in good standing in other jurisdictions to practice in New York on a limited basis for specified charitable events. The proposed authorization would provide a framework for charitable initiatives across the licensed professions that seek to reduce disparities and increase access to professional services for underserved communities while maintaining appropriate safeguards for the public. The proposed amendment was presented to the Professional Practice Committee for recommendation to the Full Board for adoption as an emer- gency rule at the July 2026 meeting of the Board of Regents, effective July 13, 2026. Since the Board of Regents meets at fixed intervals, the earliest the proposed amendment could be adopted by regular (nonemer- gency) action after expiration of the 60-day public comment period provided for in the State Administrative Procedure Act (SAPA) sections 201(1) and (5) would be the November 2026 Regents meeting. Further- more, pursuant to SAPA 203(1), the earliest effective date of the proposed rule, if adopted at the November meeting, would be November 25, 2027, the date the Notice ofAdoption would be published in the State Register. However, the emergency rule will expire October 12, 2026. Therefore, a second emergency action is necessary at the September 2026 Regents meeting, effective October 13, 2026, for preservation of the public health and public general welfare to immediately establish a Temp
