Summary

The Texas Parks and Wildlife Department proposes an amendment to 31 Texas Administrative Code §51.170, concerning General Plan for Prescribed Burning on TPWD Lands. The proposed amendment would eliminate superfluous provisions that are not required by statute and need not be prescribed by rule. The proposed amendment either implements or is consistent with the recommendations of the Texas Regulatory Efficiency Office within the Office of the Governor. Robert Macdonald, Regulations Coordinator, has determined that for each of the first five years that the rule as proposed is in effect, there will be no fiscal implications to state or local governments as a result of administering or enforcing the rule. Mr. Macdonald also has determined that for each of the first five years the rule as proposed is in effect, the public benefit anticipated as a result of enforcing or administering the proposed rule will be execution of the recommendations of the Texas Regulatory Efficiency Office within the Office of the Governor.
