Summary

The Texas Department of Housing and Community Affairs (the Department) adopts, without changes to the text previously published in the May 22, 2026 issue of the Texas Register (51 TexReg 3482), the repeal of 10 TAC Chapter 2, Subchapter D, Debarment from Participation in Programs Administered by the Department, §2.401 General. The rule will not be republished. The purpose of the repeal is to eliminate the outdated rule and replace it simultaneously with a new rule that incorporates changes to the HOME Final Rule published by the United States Department of Housing and Urban Development (HUD), changes pursuant to Section 401(a) of the Personal Responsibility and Work Opportunity Reconciliation Act of 1996 (PRWORA), and minor rule clarifications. Tex. Gov't Code §2001.0045(b) does not apply because there are no costs associated with the repeal.
