On behalf of the Indiana Department of Transportation (INDOT), INDOT is submitting this notice in compliance with IC 4-22-2-19, which requires an agency to begin the rulemaking process not later than 60 days after the effective date of the statute that authorizes the rule, unless a notice is filed with the publisher that includes the reasons why rulemaking began more than 60 days after the effective date. IC 4-22-2.3-1(a)(2), the statute authorizing this rulemaking, became effective on July 1, 2023. However, INDOT did not begin the formal rulemaking process within 60 days of IC 4-22-2.3-1(a)(2) because Executive Order 25-70, dated September 23, 2025, approved postponing the expiration date of the rules until January 1, 2027, to allow INDOT to add, amend, readopt, and repeal rules through the regular rulemaking process under IC 4-22-2. The complexities and time involved with performing the regulatory analysis, obtaining feedback on the proposed rule, obtaining approval to commence rulemaking, and complying with statutory requirements also extended the time to begin the formal rulemaking process under IC 4-22-2.6-2(2). INDOT initiated the rulemaking process on July 22, 2026, by publishing its Notice of First Public Comment Period.
