I. Background
On July 1, 2025, MSHA published the proposed rule, ``Roof Control Plan Approval Criteria'' (90 FR 28432). During the comment period, MSHA received a request for a public hearing on the proposed rule. MSHA is reopening the comment period on the proposal and announcing a virtual public hearing to allow industry, labor, and other interested parties an additional opportunity to present oral statements, written comments, and other information on the proposed rule.

“Because current law already contains robust procedural checks against arbitrary District Manager demands, eliminating Section 75.222(a) authority under the guise of preventing "overreach" is legally unfounded. The proposed deletion of District Manager discretion in 30 CFR Section 75.222(a) violates 30 U.S.C. Section 811(a)(9), subverts Congressional intent under 30 U.S.C. Section 862(a), and constitutes arbitrary and capricious rulemaking under 5 U.S.C. Section 706(2)(A). See attached file(s)”

The notice states that "[t]he proposal would eliminate the provision in 30 CFR 75.222(a) that allows the District Manager to require additional...”
