Summary

On behalf of the Indiana Department of Transportation (INDOT), this notice is submitted in compliance with IC 4-22-2-19, which requires an agency to begin the rulemaking process not later than 60 days after the effective date of the statute that authorizes the rule, unless a notice is filed with the publisher that includes the reasons why rulemaking began more than 60 days after the effective date. IC 4-22-2-19.6, the statute authorizing this rulemaking, became effective on July 1, 2023. However, INDOT did not begin the formal rulemaking process within 60 days of the authorizing statutes or IC 4-22-2-19.6 because of the complexities and time involved with setting forth the fees, performing the regulatory analysis, obtaining feedback on the proposed rule, and complying with the statutory requirements.
