Summary

On behalf of the Indiana Department of Labor (IDOL), this notice is submitted in compliance with IC 4-22-2-19, which requires an agency to begin the rulemaking process not later than 60 days after the effective date of the statute that authorizes the rule, unless a notice is filed with the publisher that includes the reasons why rulemaking began more than 60 days after the effective date. IC 4-22-2-19.6, the statute authorizing this rulemaking, became effective on July 1, 2023; however, IDOL did not begin the formal rulemaking process within 60 days of the effective date due to the complexities and time involved with complying with the statutory requirements, as well as staffing issues. The initial presentation to the budget committee was also not able to be scheduled until April 19, 2024, due in part to the number of agencies scheduling presentations to comply with the law.
