This rule replaces the interim final rule found in LSA Document #24-319. The rule pertains to permits for the relocation of outdoor advertising signs. III. Impacted Parties. The impact on the outdoor advertising industry should be minimal as the rule clarifies rather than changes a procedure. There should be little to no impact on other parties. Between FY 2016 and FY 2021, construction affected an average of fifteen signs per each year, where billboards were either relocated or modified. Since the option of the “relocation” outdoor sign permit application has been introduced, there has only been one application properly made under that option in INDOT’s electronic permit system. Although financial impacts would be minimal, the entities affected by the rule could include: Other than the savings of the $100 permit application fee, other potential finance impacts could include the following cost to the permittee, which may also indirectly impact the property owner (no data exists to ascertain the actual costs): preparation of documents requested by INDOT to demonstrate actions taken to relocate the sign in good faith. IV. Changes in Proposed Rule. The proposed rule makes no changes to the interim rule that was effective on November 6, 2024. INDOT does not foresee any costs incurred due to the proposed rule. The benefits of the proposed rule will continue to exceed any costs to the regulated industry. IX. Contact Information of Staff to Answer Substantive Questions
