Summary

On behalf of the Indiana Professional Licensing Agency and the Indiana Board of Pharmacy (board), I am submitting this notice in compliance with IC 4-22-2-19, which requires an agency to begin the rulemaking process not later than 60 days after the effective date of the statute that authorizes the rule. The board was unable to begin the rulemaking process within 60 days of the statute authorizing the rule due to high work volumes and staffing turnover in the pharmacy and legal divisions. On July 1, 2020, House Enrolled Act (HEA) 1207 went into effect, adding IC 25-26-13-31.7. HEA 1207 permits pharmacy technicians to administer influenza immunizations, subject to the rules adopted by the board. On July 1, 2022, HEA 1169 went into effect and amended IC 25-26-13-31.7 to expand the scope in which pharmacy technicians and pharmacist interns may administer any immunizations as delegated by the pharmacist. Prior to the amendment, pharmacy technicians were only permitted to administer influenza or coronavirus disease immunizations. The law requires pharmacy technicians to be certified to administer immunizations pursuant to a training program approved by the board. The board issued an emergency rule, LSA #22-361(E) adding the provisions to 856 IAC 4, which expired on October 1, 2024. The board issued an interim rule, LSA #24-317, to extend the provisions of 856 IAC 4 through November 30, 2025, and to allow the board time to promulgate a final rule.
