Summary

On behalf of the Natural Resources Commission (commission), in coordination with the Department of Natural Resources (department), I am submitting this notice in compliance with IC 4-22-2-19, which requires an agency to begin the rulemaking process for new rules not later than 60 days after the effective date of the statutes that authorize the rules, unless a notice is filed with the publisher that includes the reasons why rulemaking began more than 60 days after the effective date. To comply with IC 4-22-2-19(b) and IC 4-22-2-19(c), we are asking for an extension on the following: The commission, in coordination with the department, was unable to begin the rulemaking process within 60 days of the authorizing statute’s effective date regarding low head dam regulations because of: (1) resource constraints and staffing issues; (2) looming deadlines of other legal products to the Governor’s Office, the Office of Management and Budget and State Budget Agency, the General Assembly, and Legislative Council; and (3) the need for time to conduct research, solicit comment from stakeholders and customers, develop substantively accurate rules, and promulgate the rules validly through the statutory rulemaking process.
