Summary

This proposed rule establishes the Indiana Department of Homeland Security (IDHS) Radioactive Materials Control Program (RMCP). The proposed rules have been drafted to: (1) implement S.E.A. 381 (2022), which created the statutory framework governing the RMCP; (2) assume regulatory authority over radioactive materials from the federal Nuclear Regulatory Commission (NRC); and (3) ensure the State of Indiana has a compliant and compatible program for the control of Licensees who possess, use, store, transfer, and dispose of radioactive materials. The benefits of the proposed rule far outweigh the costs. This new rule is estimated to provide the State with an additional $5,512,000 in yearly revenue from fees collected by the State which were previously going to the federal government. The benefits of the proposed rule are identified in the “Benefits” document attached as Exhibit A to this submission. The costs of the proposed rule include staffing, training, and equipment purchases and are identified in the “Costs” document attached as Exhibit B to this submission. The costs attached in the regulatory analysis are the proposed fee schedule for what IDHS would charge, but they are already being charged by the federal government. No new costs are being created with this rule, just shifting to being collected by Indiana instead of the federal government in exchange for Indiana taking over some of the regulatory duties. These fees will be the same regardless of if the proposed...

I. Description of Rule

II. Fiscal Impact Analysis III. Impacted Parties IV. Changes in Proposed Rule V. Benefit Analysis The benefits of the proposed rule far outweigh the costs. The benefits of the proposed rule are identified in the “Benefits” document attached as Exhibit A to this submission.

VI. Cost Analysis
