On behalf of the Indiana Finance Authority (IFA), I am submitting this notice in compliance with IC 4-22-2-19(b), which requires an agency to begin the rulemaking process not later than sixty (60) days after the effective date of the statute that authorizes the rule. IFA did not begin the rulemaking process within sixty (60) days because prior administrations determined it was unnecessary because tolls are imposed and collected by a private contractor pursuant to a concession and lease agreement executed in 2006, amended and restated in 2017, and amended in 2018 (the Lease). The tolls are neither imposed nor collected directly by IFA. There has consistently been constructive notice of the toll rates because the contractor is contractually obligated to provide notice to the public of the toll rates and the annual increase authorized by the Lease. The current rule does not alter either the toll rates or the method of computing the annual increase set forth in the Lease. In addition, the amendments to the authorities for the rule, IC 8-15-2-17.2 and IC 8-15.5-7-8, by Sections 82 and 83, respectively, of P.L.93-2024 did not pertain to the substance of the rule.

TITLE 135 INDIANA FINANCE AUTHORITY 60 Day Requirement (IC 4-22-2-19) LSA Document #25-325 On behalf of the Indiana Finance Authority (IFA), I am submitting this notice in compliance with IC 4-22-2-19(b), which requires an agency to begin the rulemaking process not later than sixty (60) days after the effective date of the statute that authorizes the rule. IFA engaged in the rulemaking process in 2024 by the adoption of an Interim Final Rule, LSA Document #24-274, and by publishing its Notice of First Public Comment Period for the rule referenced above in the Indiana Register on July 9, 2025 (DIN: 20250709-IR-135250325FNA). There are no substantive differences between the Interim Final Rule and the proposed Final Rule. Andrew P. Seiwert General Counsel Indiana Finance Authority
