Air Pollution Control Division Docket 25-204 Notice

in-20250910-IR-326250204SCA: A Notice of Second Public Comment Period was published July 30, 2025, in the Indiana Register (DIN: 20250730-IR-326250204SNA) to add rules at 326 IAC 10-7 concerning reasonably available control technology (RACT) requirements for nitrogen oxides (NOx) emissions in portions of Lake and Porter counties. Specifically, this rulemaking applies to Calumet, Hobart, North, Ross, and St. John townships in Lake County, and Center, Jackson, Liberty, Pine, Portage, Union, Washington, and Westchester townships in Porter County. The Notice of Second Public Comment Period inadvertently omitted complete responses to written comments the Indiana Department of Environmental Management (IDEM) received in response to the April 4, 2025, Notice of First Public Comment Period (DIN: 20250409-IR-326250204FNA). In the interest of transparency and ensuring public participation, IDEM is including those responses in this notice and providing an additional thirty (30) days for submission of comments on the rulemaking. Comments submitted to IDEM from the original Notice of Second Public Comment Period are considered part of the formal written record. IDEM seeks comment on the affected citations listed and any other provisions of Title 326 that may be affected by this rulemaking.
