TITLE 365 CREAMERY EXAMINING BOARD Notice of Public Comment Period for Rule Readoption LSA Document #25-384 Readopts rules in anticipation of IC 4-22-2.6, providing that an administrative rule adopted under IC 4-22-2 expires January 1 of the fifth year after the year in which the rule takes effect unless the rule contains an earlier expiration date. Effective 30 days after filing with the publisher. STATUTORY AUTHORITY: IC 15-18-2 OVERVIEW Rules to be readopted without changes are as follows: Rules to be repealed are as follows: SUMMARY OF FINDINGS UNDER IC 4-22-2.6-4 The Indiana Creamery License Division currently administers the licensing and regulatory oversight of creameries operating within the state of Indiana under applicable statutory authority and administrative rules. The creamery license rule is necessary to ensure consistent implementation, uniform standards, and compliance with statutory requirements governing the production and sale of dairy products. The rule provides essential operational and regulatory guidance that cannot be sufficiently addressed through statute alone, supporting industry accountability. The rule does not impose any fees, fines, or civil penalties beyond those already established. There are no changes to previously prepared cost-benefit, economic impact, fiscal impact, or regulatory burden analyses. No less costly or less intrusive alternative methods were identified that would effectively achieve the objectives of the rule for small businesses and other regulated entities. Additionally, there have been no changes in technology, economic conditions, or other relevant factors affecting the regulated area since the rule was last adopted, readopted, or amended in the Indiana Register.
