Summary

The Private Investigator and Security Guard Licensing Board (board) is soliciting public comment on amending rules at 874 IAC 2-1-1 concerning the fee for late license renewal for private investigator firms and security guard agencies. Before House Enrolled Act 1623 (HEA 1623) was passed in 2023, the Indiana professional licensing agency (PLA) and its various professional boards historically charged a $50 late license renewal fee. Licensees under the board are required to renew their licenses every fourth year, with the next renewal in 2027. The purpose of the proposed rule is to reinstate the ability to collect late renewal fees charged to licensees by the board in conformance with IC 4-22-2-19.6(b), enacted after HEA 1623, and IC 25-1-8-6. It is now required that all fees be set as a specific dollar amount, and that details surrounding the fee be described within an administrative rule. This proposed rule was reviewed and approved by the budget committee April 19, 2024, and does not require further review by the budget committee. Licensees are the primary parties impacted by the proposed rule. The number of expected late renewals during the 2027 cycle is estimated at 181 based on the last renewal cycle. Fees will be assessed to each licensee who fails to timely renew. The implementation costs of the proposed rule are not expected to exceed the threshold set in IC 4-22-2-22.7(c)(6). For purposes of IC 4-22-2-28.1, small businesses affected by this rulemaking may contact...
