Summary

This notice is submitted in compliance with IC 4-22-2-19, which requires an agency to begin the rulemaking process not later than 60 days after the effective date of the statute that authorizes the rule, unless a notice is filed with the publisher that includes the reasons why rulemaking began more than 60 days after the effective date. Over sixteen years ago, IC 4-33-22-12 gave the Indiana Gaming Commission (commission) the authority to adopt rules regulating combat sports and the discretion to decide which of the listed combat sports to regulate. Since then, it has been a policy decision to have rules regulating only certain combat sports listed in the statute. This rulemaking comes after House Enrolled Act 1073 became effective July 1, 2025, which requires the commission to adopt rules regulating all combat sports listed in IC 4-33-22-12. At that time, the commission began the process of promulgating interim final rules, which became effective November 26, 2025. The commission received no comments during the promulgation of interim rules but wanted industry input before proceeding with final rulemaking. Once the interim rules were implemented, the commission received enough industry feedback to move forward with final rule promulgation.
