TITLE 675 FIRE PREVENTION AND BUILDING SAFETY COMMISSION Notice of Second Public Comment Period LSA Document #26-62 INDIANA ELECTRICAL CODE UPDATES PURPOSE OF NOTICE The Fire Prevention and Building Safety Commission (commission) is soliciting public comment on adding and repealing rules at 675 IAC 17 concerning the Indiana Electrical Code. HISTORY Notice of First Public Comment Period: 20260311-IR-675260062FNA Regulatory Analysis submitted with Notice of First Public Comment Period: 20260311-IR-675260062RAA Date of First Hearing: April 16, 2026 ADDITIONAL DOCUMENTS Regulatory Analysis: No changes were made to the Regulatory Analysis published with the Notice of First Public Comment Period. Notice of Public Hearing: 20260617-IR-675260062PHA CITATIONS AFFECTED: 675 IAC 17-1.8; 675 IAC 17-1.9 AUTHORITY: IC 22-13-2-2; IC 22-13-2-13 OVERVIEW Basic Purpose and Background The current Indiana Electrical Code, 675 IAC 17-1.8, was adopted and updated in 2009. These rules establish the regulatory framework that sets forth enforceable standards for electrical systems and components to protect life, health, and safety of building occupants and the public. IC 22-12-2.5-3 permits the commission to decide which building codes can be reviewed each calendar year. The Indiana electrical code update committee (committee), a subcommittee of the commission, was tasked with reviewing the 2023 NFPA National Electrical Code. The committee then made recommendations to alter the rule via proposed amendments that the members felt were appropriate to update the current Indiana Electrical Code under 675 IAC 17-1.8. It is necessary to repeal the 2009 Indiana Electrical Code and replace it with the 2026 Indiana Electrical Code because the 2026 version will have incorporated the latest advancements in technology, addressing emerging electrical hazards and maintaining compliance with the latest standards. If the Indiana Electrical Code is updated to the 2026 version, people and property will ultimately be protected from electrical accidents, ensuring the safety of residents and visitors across the state. This proposed rule was drafted by an internal working group for the commission, at the department of homeland security, and has taken into account comments and concerns received by interested stakeholders. The implementation costs of the proposed rule are not expected to exceed the threshold set in IC 4-22-2-22.7(c)(6). For purposes of IC 4-22-2-28.1, small businesses affected by this rulemaking may contact the Small Business Regulatory Coordinator: For purposes of IC 4-22-2-28.1, the Small Business Ombudsman designated by IC 5-28-17-6 is: Resources available to regulated entities through the small business ombudsman include the ombudsman's duties stated in IC 5-28-17-6, specifically IC 5-28-17-6(9), investigating and attempting to resolve any matter regarding compliance by a small business with a law, rule, or policy administered by a state agency, either as a party to a proceeding or as a mediator. EXPLANATION OF DIFFERENCES IN PROPOSED RULE 675 IAC 17-1.9-13 was amended to add the deletion of Section 210.12(B). This amendment was made based on public comments and the action of the Indiana General Assembly. Section 8 of Public Law 73 added IC 22-13-2-3.6, which prohibits the commission or another state agency from adopting rules requiring the installation of an arc-fault circuit interrupter (AFCI) in a Class 2 structure or a structure classified as an R-2 building occupancy classification under the Indiana building code constructed after June 30, 2026. This also eliminates the cost impact of $7,500,000. PROPOSED RULE Sec. 1.
