Summary

The Department of Financial Institutions (DFI) is soliciting public comment on temporarily amending rules at 750 IAC 1-1-1 concerning adjustments to multiple dollar amounts in consumer lending. The Indiana General Assembly enacted Senate Bill 169 during the 2026 legislative session. The measure was signed into law by Governor Braun on March 5, 2026. The legislation repeals existing provisions of the Indiana Code that provide current authority for this rulemaking. In place of the repealed provisions, the General Assembly recodified the statutory framework into a newly created Title 37 of the Indiana Code, including the newly recodified rulemaking authority. The statutory changes established under Senate Bill 169 take effect July 1, 2026. The proposed interim rule amends 750 IAC 1-1-1. In this rulemaking, there are amendments to dollar amounts for eight (8) provisions in the Uniform Consumer Credit Code under IC 37-2, three (3) provisions in small loans under IC 37-3, and one (1) provision for high-cost home loans under IC 37-5-2-8. The dollar amounts are adjusted every two (2) years to account for inflation, based on a formula set forth in IC 37-2-1-5, effective July 1, 2026. Creditors and debtors will be affected by the rulemaking. DFI determined that the proposed interim rule, as amended, will impose no additional requirements or costs on a regulated entity. As set forth in IC 37-2-1-5, DFI relied on the Consumer Price Index for urban wage earners in setting the proposed...
