10. Fiscal Impact Statement (Prepared by Legislative Budget Assistant):

FIS #: 26:222, dated: Monday, October 12, 2026

1. Comparison of the costs of the proposed rule(s) to the existing rule(s):

When compared to the existing rules, the proposed rules will have an indeterminable impact on state expenditures.

2. Cite the Federal mandate. Identify the impact on state funds:

Public Law 119-21, section 71119 (aka the “One Big Beautiful Bill Act”) requires states to implement community engagement requirements for adult expansion Medicaid groups effective January 1, 2027. Existing administrative rules promulgated by the Department of Health and Human Services already contemplate a community engagement requirement, as one was put into effect by state law in 2019. However, subsequent court and legislative actions prevented the requirement from taking effect. The proposed rule revisions, therefore, reflect the differences between the new, federally mandated requirement and the original state requirement. Any cost impact is indeterminable.

A. To State general or State special funds:

The Department notes that there may be an indeterminable increase in administrative costs resulting from the need to implement the new federal requirements. The precise impact, however, is indeterminable, and the Department has received a federal grant to make system changes for program implementation. ADMINISTRATIVE RULES (603) 271-3680 Generated on 10/13/2026

B. To State citizens and political subdivisions:

None. As noted in response to 2 above, existing rules already contained a community engagement requirement that never took effect; the proposed rules are being amended not to create a new requirement, but to comply with the specific provisions contained in federal law.

C. To independently owned businesses:

None. 11. Statement Relative to Part I, Article 28-a of the N.H. Constitution: Although the proposed rule modifies existing responsibilities, it does not mandate any fees, duties, or expenditures on the political subdivisions of the state, and therefore does not violate Part I, Article 28-a of the N.H. Constitution. ADMINISTRATIVE RULES (603) 271-3680 Generated on 10/13/2026
