A total of at least 10 DDAPs must be purchased per property listed on the DRP in order to be eligible for a SDRP along with the requirements of subsection (c). DEPARTMENT OF NATURAL RESOURCES NOTICE OF ADOPTED RULE c) Supplemental Deer Removal Permits Landowners or tenants who, between themselves and their designated shooters, successfully fill at least 80% of their DDAPs issued to all persons listed on the DRP will automatically become eligible to receive a SDRP in the following calendar year for use during a period beginning June 1 and ending September 15. Section 526.70 Evaluation of Damage a) Deer Removal Permits. Permits to remove deer causing damage will be evaluated using the following criteria: 1) Soybeans – DRPs will not be issued when damage is limited to plants within 5m (15 ft.) of a field edge. DRPs may be issued when 67-100% of the leaves are eaten from young plants (35-40 days post-emergent) outside the 5-meter border. 2) Corn – DRPs will not be issued when damage is limited to plants within 5m (15 ft.) of a field edge. DRPs may be issued when >5% of the plants (in an individual field) are destroyed outside the 5-meter border. 3) Tree nurseries, orchards, and Christmas tree farms – DRPs will not be issued for fields less than 10 acres in size unless to augment other techniques (such as fencing, deterrents, or repellents) already in use. DRPs may be issued when at least 10% of a specific species of seedling, whip or sapling trees <2" diameter at breast height (4.5 feet above ground level) within a field is damaged. Damage to larger stock entails greater loss or cost per tree damaged; therefore the 10% required of this subsection (a)(3) does not apply. 4) Baled hay – DRPs will not be issued for damage to baled hay. Damage to baled hay can be alleviated by centralizing bales and protecting by electric fence. 5) Wildlife food plots – DRPs will not be issued for damage to wildlife food plots. Food plots are planted for the purpose of feeding wildlife. 6) Ornamental plantings – DRPs will not be issued for browsing or rubbing of ornamental plants unless to augment other techniques (such as fencing, deterrents, or repellents) already in use. 7) Fencing – DRPs will not be issued for fencing knocked down by deer until after the landowner attempts to alleviate the problem through the addition and installation of colored electric vinyl fencing, or use of highly-visible flagging on the section of fence being damaged. 8) Reforestation/restoration plots, conservation reserve acres, and other natural areas – DRPs will not be issued for deer-related damage to naturally occurring/regenerating trees. Often the source of damage in these situations is due to a localized overabundance of deer. Planting trees or other plants in areas known to be occupied by deer necessitates other forms of damage abatement be implemented at the time of planting/seeding (e.g., tree shelters, fencing or other forms of exclusion) as well as increasing hunter access and harvest of does. However, if seedling survival of planted trees is reduced to <70% stocking rate, then a DRP may be issued to augment other forms of damage abatement. DRPs will not be issued during, or between, regular firearm deer seasons nor during the first part of the archery deer season (i.e., prior to the first firearm season) unless antler-rubbing damage is the primary reason for the tree seedling mortality. 9) Other crops (small grains, including winter wheat), hay, specialty crops (strawberries, melons, pumpkins, etc.), including family garden plots and truck farms – DRPs will not be issued for plots less than five acres in size and not if damage is mostly limited to field perimeters or along access roads unless to augment other techniques (such as fencing, deterrents or repellents) already in use. DRPs may be issued to reduce damage to winter wheat only in the spring after the early jointing stage (when growing points ("joints") or nodes are above the soil surface). b) Permits to remove deer posing a risk to human safety. 1) Airports – when human safety is an immediate concern (such as with deer on runways), a DRP will be issued immediately, followed up by a site inspection and the written permit. However, since issues with deer on airport runways or taxiways can be sporadic, but require an immediate DEPARTMENT OF NATURAL RESOURCES NOTICE OF ADOPTED RULE response, airports are eligible for DRPs even when only the potential for risk to human safety exists. 2) Other risks to human safety – when human safety is an immediate concern, a DRP will be issued immediately, followed up by a site inspection and the written permit. When the risk to human safety is not an immediate concern, each situation will be evaluated on a case-by-case basis to determine whether a permit is warranted and for what duration and number of deer. Section 526.80 Approved Methods of Take: White-tailed Deer a) Deer Removal Permits and Supplemental Deer Removal Permits. Firearm or lighting device use under a DRP or SDRP is subject to the following restrictions and permissions: 1) Only rifles .243 caliber and larger or 10-20 gauge shotguns with slugs, may be used to take deer under a DRP or SDRP. Rifles and shotguns with slugs may not be used within 300 yards of an inhabited dwelling without first obtaining written permission from the owner or tenant (see 520 ILCS 5/2.33(u)). 2) Shining, or the use of artificial light from a vehicle while actively attempting to take deer, as well as the use of a lighting device is allowed while removing deer pursuant to a DRP or SDRP that has been issued for damage and is subject to the following restrictions: A) Allowing the use of a lighting device is at the discretion of the Department. Such authorization will be listed on the DRP or SDRP if such use is authorized by the Department. B) When using a lighting device from a vehicle or conveyance, all firearms must be unloaded and enclosed in a case. (See 520 ILCS 5/2.33(n).
