This proposed rule establishes the process by which the Department will issue 45 cannabis infuser licenses as required by Public Act 104-463. All applicants must meet specified social equity criteria. If the Department receives more than 45 qualifying applications, it may conduct a lottery, in which applicants who can demonstrate experience operating a hemp business will receive an additional draw. The licensing process will proceed in five steps: (1) applicants submit a pre-application certifying that they meet the social equity requirements and, if applicable, that they have experience operating a hemp business; (2) the Department either conducts a lottery or confirms that it received 45 or fewer applications; (3) selected applicants submit documentation verifying that they meet the social equity requirements and, if claimed, the hemp business experience; (4) once that documentation is verified, applicants submit a full infuser application, including a business plan, security plan, and other required plans; and (5) upon receipt of a complete application, the Department issues the license
