This Notice of Intent will have no impact on the six criteria set out at R.S. 49:972(B). Poverty Impact Statement The proposed rulemaking will have no impact on poverty as described in R.S. 49:973. Small Business Analysis The proposed Rule change is not anticipated to have an adverse impact on small businesses. The repeals of §§309, 319, 327.A through C, and 337 remove provisions that are duplicative of statute or rest on repealed statutory authority, and they impose no new requirement on any regulated person. Repeal of Chapter 7 discontinues the Louisiana Wild Seafood Certification Program, in which participation is voluntary and many participants are small businesses. The repeal imposes no new requirement and relieves participating commercial fishermen, dealers, retailers, and restaurants of the permit application, annual renewal, program training, product registration, invoice submission, and recordkeeping obligations of §§703, 704, and 707. Participants who have invested in packaging, labels, signage, or marketing materials bearing the program logo will no longer be authorized to use the logo once the repeal becomes effective, and the department will provide notice sufficient to allow existing inventory to be exhausted. The amendment to LAC 76:I.321 consolidates two overlapping confidentiality Sections into one and does not reduce the protection afforded to data submitted by commercial fishermen, wholesale/retail dealers, or for-hire operators. The amendment to the title of Part I is descriptive and imposes no requirement on any person. Provider Impact Statement This proposed Rule has no known impact on providers as described in HCR 170 of 2014. Public Comments Written comments should be addressed to Cole Garrett, General Counsel, Department of Wildlife and Fisheries, P.O. Box 98000, Baton Rouge, LA 70898-9000, or via e-mail to cgarrett@wlf.la.gov prior to 4:30 p.m., November 25, 2026. Kenneth A. “Andy” Brister Chairman FISCAL AND ECONOMIC IMPACT STATEMENT FOR ADMINISTRATIVE RULES RULE TITLE: Rule Review and Streamlining under Executive Order JML 25-038 I.ESTIMATED IMPLEMENTATION COSTS (SAVINGS) TO STATE OR LOCAL GOVERNMENT UNITS (Summary) The proposed rule changes are not anticipated to impact the costs or savings of the Louisiana Department of Wildlife and Fisheries (LDWF) or any other state or local governmental units. The proposed rule change updates and clarifies regulations governing the confidentiality of fishery dependent data, specifically commercial and for-hire landings. The proposed rule change specifies who may access confidential data, establishes procedures for complying with federal confidentiality requirements, and extends penalties for unauthorized disclosure to contractors. Additionally, the proposed rule change removes outdated or duplicative provisions related to recreational licensing and eliminates the Louisiana Wild Seafood Certification Program. II.ESTIMATED EFFECT ON REVENUE COLLECTIONS OF STATE OR LOCAL GOVERNMENTAL UNITS (Summary) The proposed rule change is not anticipated to impact the revenue collections of LDWF or any other state or local governmental units. III.ESTIMATED COSTS AND/OR ECONOMIC BENEFITS TO DIRECTLY AFFECTRED PERSONS, SMALL BUSINESSES, OR NONGOVERNMENTAL GROUPS (Summary) The proposed rule change is anticipated to have a long-term economic benefit, but may have short-term costs for directly affected small businesses. The proposed rule change repeals the Louisiana Wild Seafood Certification Program, which will relieve participating commercial fishers, seafood dealers, retailers, and restaurateurs of the permit application, annual renewal, program training, invoice submission, and recordkeeping requirements. Entities that invested in packaging labels, signage, or marketing materials bearing the program’s logo will no longer be able to use them upon promulgation of the proposed rule change. The program currently has 12 entities that utilize the participant permit, but the overall impact on costs for these entities is dependent on the amount of inventory they have on hand at the time of promulgation. IV.ESTIMATED EFFECT ON COMPETITION AND EMPLOYMENT (Summary) The proposed rule change is not anticipated to impact competition or employment in the public or private sectors.
