Chad Sonnier Chief FISCAL AND ECONOMIC IMPACT STATEMENT FOR ADMINISTRATIVE RULES RULE TITLE: Boiler Construction, Maintenance, Inspection and General Use I.ESTIMATED IMPLEMENTATION COSTS (SAVINGS) TO STATE OR LOCAL GOVERNMENT UNITS (Summary) There are no anticipated costs or savings to state or local governmental units as a result of the proposed rule change. In compliance with Act 842 of the 2026 RS, the Department of Public Safety (DPS), Office of State Fire Marshal (OSFM), proposes to amend Sections 5002, 5005, 5003, 5006, 5007, 5008, 5009, 5010, 5011, 5012, 5014, 5015, 5017, 5020, 5034, 5035, 5052, 5055, 5058, 5060, 5085, 5086, and 5089; adopt Sections 5004, 5005, and 5019; and repeal Section 5089, all within Part V (Office of the State Fire Marshal) of Title 55 (Public Safety), Chapter 50 (Boiler Construction, Maintenance, Inspection and General Use) of the Louisiana Administrative Code. The proposed rule removes outdated boiler inspection and licensing provisions and replaces them with a revised regulatory framework administered by OSFM, while establishing statewide requirements for boiler inspections, licensing, operating certificates, fees, and enforcement. Specifically, this proposed rule: Increases the certificate fee from $20 or $40 to $150 for the Operating Certificate, which replaces the existing Certificate of Inspection: The current fees are $20 for an inspection certificate valid for up to 14 months and $40 for a certificate issued for an extension of the internal inspection period. Modifies the fee for an Operating Certificate valid for up to 5 years from $200 to $150, replacing the current inspection certificate. The $150 Operating Certificate also replaces the Boiler Inspection Fee, which currently ranges from $15 to $150 based on a fee schedule determined by the size and type of boiler. Increases from $25 to $150 for the permit to install, move, or reinstall a boiler. Increases from $50 to $150 for the installer exam fee. Increases from $75 annually to $100 initially and $50 annually for renewal for the installer license. Establishes administrative penalties and sanctions for violations of the boiler laws and rules, including minor, serious, and major offenses, with penalties ranging from warnings and monetary fines to license suspension or revocation. The penalty amounts vary based on the severity of the violation and whether the violation is committed by a firm/individual or an employee/individual, with fines of up to $250 per day for firms/individuals and $5,000 for employees/individuals, and the OSFM authorized to impose additional administrative sanctions or pursue injunctive relief. II.ESTIMATED EFFECT ON REVENUE COLLECTIONS OF STATE OR LOCAL GOVERNMENTAL UNITS (Summary) In compliance with Act 842 of the 2026 RS, OSFM establishes new and increases current boiler-related fees, which are anticipated to increase OSFM revenues by approximately $815,290 annually, consisting of $565,880 from insurance company certificates, $202,285 from boiler inspections, and $49,125 from applications and license renewals. However, the actual revenue impact may vary based on the number of boilers subject to regulation, inspection, and certification requirements and the frequency of required inspections, as some boilers require inspection every two years while others require inspections twice annually. The anticipated $815,290 increase is detailed below: $563,880 increase from increased fees for insurance company boiler certifications, consisting of $1,100 from 10 one-year certificate extensions, $256,750 from 1,975 one-year certificates, $308,880 from 2,808 two-year certificates, and a $2,850 decrease from 57 five-year certificates. $202,285 increase from applying the new $150 fee to the 2,099 boiler inspections conducted in FY 25, which would generate approximately $314,850 in revenue compared to current inspection fee revenue of $112,565. $49,125 increase from changes to applications and renewal fees, consisting of $36,000 from 288 applications to install and $13,125 from 105 license renewals to inspect. Additionally, Act 842 of the 2026 RS authorizes OSFM to impose administrative penalties for violations of the boiler laws, with fines ranging up to $250 per day for firms and individuals and ranging from $10 to $5,000 for employees and individuals, depending on the severity of the violation. To the extent violations occurs, OSFM revenue will increase accordingly. However, the revenue impact is indeterminable and will depend on the number and severity of violations and whether the violation is committed by an individual, employee of a firm, or the firm itself. III.ESTIMATED COSTS AND/OR ECONOMIC BENEFITS TO DIRECTLY AFFECTRED PERSONS, SMALL BUSINESSES, OR NONGOVERNMENTAL GROUPS (Summary) Insurance companies, boiler owners and users, boiler installers, inspectors, firms, employees, and other individuals subject to the boiler laws will incur increased costs to the extent applicable. Boiler owners and users currently pay $20 for each inspection certificate, which is valid for up to 14 months, and $40 for certificates issued for an extension of an internal inspection or a two-year inspection frequency. Owners and users also pay inspection fees ranging from $15 to $150, depending on the size and type of boiler. These fees will be replaced by a $150 operating certificate fee. Individuals applying for a boiler installation license currently pay $75 annually, which will increase to $100 for an initial license and $50 for annual renewal. IV.ESTIMATED EFFECT ON COMPETITION AND EMPLOYMENT (Summary) Implementation of this proposed rule is not anticipated to have an effect on competition and employment. Chad P.
