No. PSC-40-26-00001-P PURSUANT TO THE PROVISIONS OF THE State Administrative Pro- cedureAct, NOTICE is hereby given of the following proposed rule: Proposed Action: The Commission is considering the Utilities’ proposal to implement Phase 1 of the Excelsior Power Program, including program branding, enhanced customer incentives, and eligibility criteria. Statutory authority: Public Service Law, sections 4(1), 5(1), (2), 65(1), (5), 66(1), (12), (14), 67-b and 74 Subject: Excelsior Power Program Phase 1 Implementation Plan. Purpose: To ensure proper implementation of Phase 1 of the Excelsior Power Program. Substance of proposed rule: The Public Service Commission (Commis- sion) is considering a proposed Phase 1 Implementation Plan (Plan) for the Excelsior Power Program, which Plan was filed on September 14, 2026, by Central Hudson Gas & Electric Corporation, Consolidated Edison Company of New York, Inc., Niagara Mohawk Power Corporation d/b/a National Grid, New York State Electric & Gas Corporation, Roches- ter Gas and Electric Corporation, Orange and Rockland Utilities, Inc., The Brooklyn Union Gas Company d/b/a National Grid NY, and KeySpan Gas East Corporation d/b/a National Grid, in collaboration with PSEG Long Island (collectively, the Utilities). The Plan was submitted pursuant to the Commission’s August 13, 2026, Order Initiating Proceeding, Directing Proposal, and Soliciting Comments (August 13 Order), which directed the Utilities to file a joint proposal for the first phase of the Implementation Plan for the Excelsior Power Program. The Utilities propose to rebrand existing utility Bring Your Own Thermostat programs as the Excelsior Power Smart Thermostat Program and establish eligibility criteria and an implementation schedule for enhanced customer incentives authorized by the 2026-2027 New York State Enacted Budget. The proposed enhanced incentive would provide eligible new participants with up to $300 during their first year of participation, consisting of a $100 payment upon enrollment and a $200 payment following completion of 12 months of participation, subject to customer performance and the availability and authorized disbursement of State or other non-ratepayer funding.The Utilities also propose procedures intended to prevent customers from receiving duplicate enhanced incen- tives in overlapping utility service territories, as well as timelines for implementing program branding, eligibility requirements, customer com- munications, and other necessary administrative and system changes.
