No. PSC-19-26-00017-A Filing Date: 2026-09-21 Effective Date: 2026-09-21 PURSUANT TO THE PROVISIONS OF THE State Administrative Pro- cedureAct, NOTICE is hereby given of the following action: Action taken: On 9/17/26, the PSC adopted an order granting Kiamesha Artesian Spring Water Co., Inc. and six individuals (the Petitioners) peti- tion to modify a directive of the Commission’s Order Approving Transfer of Stock and Real Property in Case 24-W-0719. Statutory authority: Public Service Law, sections 4(1), 5(1), 89b, 89-h, 108 Subject: Modification of a Commission Order. Purpose: To approve the Petitioners request to modify a directive of the Commission’s OrderApproving Transfer of Stock and Real Property. Substance of final rule: The Commission, on September 17, 2026, adopted an order granting Kiamesha Artesian Spring Water Co., Inc. (Kiamesha) and six individuals petition to modify a directive of the Com- mission’s Order Approving Transfer of Stock and Real Property in Case 24-W-0719. Kiamesha is relieved of the requirement to file copies of ease- ment agreements as specified in Ordering Clause No. 4 of the Commis- sion’s Order Approving Transfer of Stock and Real Property issued in this proceeding on August 18, 2025. Kiamesha shall file with the Secretary to the Commission, a license agreement, as discussed in the order, that ensures Kiamesha has the ability to access, operate, and maintain its water supply assets on real property it does not own, within 30 days of closing of the transfer authorized by the Commission in the Order Approving Transfer of Stock and Real Property issued in this proceeding on August 18, 2025, subject to the terms and conditions set forth in the order.
