Statutory authority: Public Service Law, sections 4(1), 5(1), (2), 66(2); and New York Energy Law, section 6-104(5)(b) Subject: Build-Ready Program. Purpose: To grant NYSERDA’s request to terminate the ratepayer funded portion of the Build-Ready program. Substance of final rule: The Commission, on September 17, 2026, adopted an granting the New York State Energy and Research Develop- ment Authority’s (NYSERDA) request to terminate the ratepayer funded portion of the Build-Ready Program made in its Five-Year Review, subject to the terms and conditions set forth in the order. Statutory authority: Public Service Law, sections 4(1), 5(1), (2), 66(2); and New York Energy Law, section 6-104(5)(b) Subject: Maintenance Tier Funding. Purpose: To authorize NYSERDA to provide ten-year maintenance tier support to Patriot. Substance of final rule: The Commission, on September 17, 2026, adopted an order authorizing the New York State Energy and Research DevelopmentAuthority (NYSERDA) to enter into a ten-year Maintenance Tier contract with Patriot Hydro Funding, LLC (Patriot) for the Hailesboro 3 facility.
